The requisite safeguards for the right to legal assistance imply, among other things, the obligation of the authorities to establish that the person did not wish to exercise that right in a particular period of time (see Yerokhina v. Ukraine, no. 12167/04, § 68, 15 November 2012).Accordingly, no issue under Article 6 of the Convention arises in connection with his contention that he was convicted on the basis of evidence obtained through ill-treatment (see Yerokhina v. Ukraine, no. 12167/04, § 77, 15 November 2012 and Nikolayenko v. Ukraine, no. 39994/06, § 71, 15 November 2012).
