The Court considers that generally a defendant, for the purposes of Article 6 § 3 (d), must be identified with the counsel who acted on his behalf, and cannot, therefore, attribute to the respondent State any liability for his counsel's decisions in the exercise of defence rights (see the Kamasinski v. Austria judgment of 19 December 1989, Series A no. 168, p. 40, §ï? 91, and also the Pullar v. the United Kingdom judgment of 10 June 1996, Reports of Judgments and Decisions 1996-III, p. 796, § 46).
