The Court has already considered that the six-month rule is a public policy rule and that, consequently, it has jurisdiction to apply of its own motion (see Assanidze v. Georgia [GC], no. 71503/01, § 160, ECHR 2004-II), even if the Government have not raised that objection (see Walker v. the United Kingdom (dec.), no. 34979/97, ECHR 2000-I).That rule marks out the temporal limit of the supervision exercised by the Court and signals, both to individuals and State authorities, the period beyond which such supervision is no longer possible (see Walker v. the United Kingdom (dec.), no. 34979/97, ECHR 2000-I).

Referring to the method of calculating the time-limit used by the Court in its interpretation of the former Article 32 of the Convention which governed the time-limit for lodging an application (see Istituto di Vigilanza v. Italy, 22 September 1993, § 14, Series A no. 265-C; Figus Milone v. Italy, 22 September 1993, § 14, Series A no. 265-D; and Goisis v. Denn bei dieser Frist handelt es sich nach der Rechtsprechung des Europäischen Gerichtshofs für Menschenrechte um eine zwingende Vorschrift, die vom Gerichtshof von Amts wegen anzuwenden ist (EGMR , Urteil vom 29. Juni 2012 - Nr. 27396/06, Sabri Günes/Türkei - NJW 2012, 2943 Rn. 29) und die die zeitlichen Grenzen einer Überprüfung durch den Gerichtshof bestimmt (…EGMR , Urteile vom 22. Mai 2012 - Nr. 5826/03, Idalov/Russland - Rn. 128 und vom 29. Juni 2012 - Nr. 27396/06 - NJW 2012, 2943 Rn. 40).Danach wird die Sechsmonatsfrist des Art. 35 Abs. 1 EMRK erst mit der Beendigung einer derartigen Situation in Gang gesetzt, wenn ein innerstaatlicher Rechtsbehelf zu ihrer Behebung fehlt (vgl. EGMR , Urteil vom 29. Juni 2012 - Nr. 27396/06 - NJW 2012, 2943 Rn. 54 …sowie Beschluss vom 14. Oktober 2008 - Nr. 6817/02, Iordache/ Rumänien - Rn. 50, jeweils m.w.N.).

Die Frist beginnt am Tag nach der Zustellung und endet sechs Kalendermonate später (st. Rspr. d. EGMR und st. Spruchpraxis der EKMR (Kommission), s. die Nachweise in EGMR, Urt. v. 29.06.2012 -/06 Günes/Türkei, NJW 2012, 2943, Rdz. 44 f., unter Hinweis auf die Übernahme der ständigen Spruchpraxis der Kommission, s.
