Otherwise, if an action based on the State's strict liability were to be considered a legal action that had to be exhausted in respect of complaints under Articles 2 and 3, the State's obligation to seek those guilty of fatal assault might thereby disappear (see, OÄ?ur v. Turkey no. 21594/93, § 66, ECHR 1999 and the Assenov and Others v. Bulgaria judgment of 28 October 1998, Reports 1998, p. 3290, § 102).
