BEIZARAS AND LEVICKAS v. LITHUANIA
Auszug aus EGMR, 30.05.2023 - 39954/09
The legal framework could also be made up of administrative or civil-law remedies capable of affording sufficient protection, possibly combined with procedural remedies such as the granting of an injunction (see, mutatis mutandis, Söderman v. Sweden [GC], no. 5786/08, §§ 85 and 108, ECHR 2013, and, by contrast, Beizaras and Levickas v. Lithuania, no. 41288/15, § 128, 14 January 2020, which, unlike the present case, concerned statements directed against the applicants personally and containing calls to make attacks on their physical integrity). - EGMR, 07.02.2012 - 40660/08

PLESHKOV AND OTHERS v. RUSSIA
Given the examples of judicial practice applying the Supreme Court Ruling, the Court considers that after its adoption the judicial review of complaints of alleged restrictions on freedom of assembly was a remedy which organisers of public events must have normally exhausted in order to comply with Article 35 § 1 of the Convention (see, by contrast, Nepomnyashchiy and Others v. Russia, nos. 39954/09 and 3465/17, §§ 78-79, 30 May 2023, where the Government failed to submit any examples of judicial practice applying a particular ruling of the Constitutional Court, and the Court retained doubts about the effectiveness of the applicable legislation in practice). - EGMR - 226/18 (anhängig)
YEVSTIFEYEV v. RUSSIA and 16 other applications
Did the domestic authorities comply with their obligation under Article 8, taken alone or in conjunction with Article 14, to respond adequately to discriminatory statements and to secure respect for the applicants' "private life" (see Nepomnyashchiy and Others v. Russia, nos. 39954/09 and 3465/17, 30 May 2023, and Behar and Gutman v. Bulgaria, no. 29335/13,16 February 2021)? Did the applicants have at their disposal an effective domestic remedy for their Convention complaints, as required by Article 13 of the Convention?.
