They referred, in particular, to the cases of Petrova v. Latvia (no. 4605/05, 24 June 2014) and Elberte v. Latvia (no. 61243/08, 13 January 2015).Did the relevant Russian legislation, as in force at the material time, meet the requirements of clarity and foreseeability? In particular, were there disagreements among the competent authorities as to the scope and interpretation of Russian legislation on organ transplantation (see Elberte v. Latvia, no. 61243/08, § 113, ECHR 2015)? Also, was any system of informing the general public about that legislation, and/or regulation in that area, in place, in accordance with the Russian Constitutional Court's decision no. 459-O of 4 December 2003?.
