BLECIC v. CROATIA
Auszug aus EGMR, 09.04.2019 - 72931/10
It has to satisfy itself that it has jurisdiction in any case brought before it, and it is therefore obliged to examine the question of its jurisdiction at each stage of the proceedings (see Blecic v. Croatia [GC], no. 59532/00, § 67, ECHR 2006-III; Uslu v. Turkey (no. 2), no. 23815/04, § 18, 20 January 2009; Boucke v. Montenegro, no. 26945/06, § 63, 21 February 2012; and Buzadji v. the Republic of Moldova [GC], no. 23755/07, § 70, 5 July 2016). - EGMR, 10.01.2017 - 32407/13
KACPER NOWAKOWSKI v. POLAND
Auszug aus EGMR, 09.04.2019 - 72931/10
It follows that family ties may only be severed in very exceptional circumstances and that everything must be done to preserve personal relations and, if and when appropriate, to "rebuild" the family (see, as a recent authority, Kacper Nowakowski v. Poland, no. 32407/13, § 75, 10 January 2017). - EGMR, 13.07.2000 - 39221/98
SCOZZARI ET GIUNTA c. ITALIE
Auszug aus EGMR, 09.04.2019 - 72931/10
However, its judgments are essentially declaratory in nature and, in general, it is primarily for the State concerned to choose the means to be used in its domestic legal order in order to discharge its legal obligation under Article 46 of the Convention, provided that such means are compatible with the conclusions set out in the Court's judgment (see, among other authorities, Scozzari and Giunta v. Italy [GC], nos. 39221/98 and 41963/98, § 249, ECHR 2000-VIII; Brumarescu v. Romania (just satisfaction) [GC], no. 28342/95, § 20, ECHR 2001-I; Akdivar and Others v. Turkey (Article 50), judgment of 1 April 1998, Reports 1998-II, pp.

GIUSTO, BORNACIN AND V. v. ITALY
Auszug aus EGMR, 09.04.2019 - 72931/10
The Government contested the first applicant's standing to represent R. before the Court, with reference to the cases of Moretti and Benedetti v. Italy (no. 16318/07, 27 April 2010) and Giusto and Others v. Italy ((dec.), no. 38972/06, ECHR 2007-V). - EGMR, 16.07.2015 - 39438/13
NAZARENKO v. RUSSIA
Auszug aus EGMR, 09.04.2019 - 72931/10
Accordingly, Article 8 of the Convention can be interpreted as imposing on member States an obligation to examine on a case-by-case basis whether it is in the child's best interests to maintain contact with a person, whether biologically related or not, who has taken care of him or her for a sufficiently long period of time (see Nazarenko v. Russia, no. 39438/13, § 66, ECHR 2015 (extracts)). - EGMR, 29.03.2016 - 16899/13
KOCHEROV AND SERGEYEVA v. RUSSIA
Auszug aus EGMR, 09.04.2019 - 72931/10
In particular, a parent cannot be entitled under Article 8 to have such measures taken as would harm the child's health and development (see, for instance, Kocherov and Sergeyeva v. Russia, no. 16899/13, § 95, 29 March 2016). - EGMR, 13.06.1979 - 6833/74
MARCKX v. BELGIUM

723-24, § 47; and Marckx v. Belgium, judgment of 13 June 1979, Series A no. 31, p. 25, § 58).
- EGMR, 29.10.2019 - 23641/17
PISICA v. THE REPUBLIC OF MOLDOVA
In particular, a parent cannot be entitled under Article 8 to have such measures taken as would harm the child's health and development (see, for instance, V.D. and Others v. Russia, no. 72931/10, § 114, 9 April 2019). - EGMR, 13.04.2023 - 66015/17
JÍROVÁ AND OTHERS v. THE CZECH REPUBLIC
In cases concerning foster parents and a child entrusted to them at a young age and having lived with them for periods of nineteen months or longer, the Court found that the resulting relationship amounted to family life, having regard to the existence of a close interpersonal bond, of a genuine concern on the foster parents' part for the child's well-being, and an emotional link between them (see Moretti and Benedetti v. Italy, no. 16318/07, §§ 51-52, 27 April 2010; Kopf and Liberda v. Austria, no. 1598/06, §§ 35 and 37, 17 January 2012, with further references; see also V.D. and Others v. Russia, no. 72931/10, §§ 90-93, 9 April 2019).The latter element cannot be satisfactorily assessed without determining, at the same time, whether the decision-making process, seen as a whole, was fair and provided the applicants with the requisite protection of their interests safeguarded by Article 8 (see V.D. and Others v. Russia, no. 72931/10, § 112, 9 April 2019).

A ET AUTRES c. ITALIE
Islande, no 71552/17, § 2, 18 mai 2021).
- EGMR, 12.11.2020 - 19511/16
HONNER c. FRANCE
Russie, no 72931/10, § 114, 9 avril 2019; voir aussi Krisztián Barnabás Tóth, précité, § 37). - EGMR, 14.01.2021 - 21052/18
TERNA c. ITALIE
Italie, no 16318/07, §§ 49-50, 27 avril 2010, Kopf et Liberda c. Autriche, no 1598/06, § 37, 17 janvier 2012 ; Antkowiak c. Pologne (dec.), n 27025/17, 22 mai 2018, et V.D. et autres c. Russie, no 72931/10, §§ 90-93, 9 avril 2019). - EGMR, 27.05.2021 - 54978/17
JESSICA MARCHI c. ITALIE
Italie, no 16318/07, §§ 49-50, 27 avril 2010, Kopf et Liberda c. Autriche, no 1598/06, § 37, 17 janvier 2012, Antkowiak c. Pologne (déc.), no 27025/17, 22 mai 2018, et V.D. et autres c. Russie, no 72931/10, §§ 90-93, 9 avril 2019). - EGMR, 05.05.2020 - 71160/13
UZBYAKOV v. RUSSIA
In respect of Russia, the Court has previously held that an interference with applicants" family life which was the result of the automatic application of inflexible legal provisions in that field amounted to a failure to respect their family life (see Nazarenko v. Russia, no. 39438/13, §§ 64-68, ECHR 2015 (extracts), and V.D. and Others v. Russia, no. 72931/10, §§ 127-131, 9 April 2019). - EGMR, 05.09.2023 - 59252/19
VINSKOVSKÝ v. THE CZECH REPUBLIC
Referring to the conditions set out in Article 927 of the Civil Code and to the application thereof (see paragraphs 19-22 above), they further contended that domestic court decisions in this area were always based on an assessment of the specific circumstances of each case and, in particular, on the best interests of the child whose participatory rights were being observed (which, in their view, distinguished the Czech law from the Russian law that was at issue in V.D. and Others v. Russia, no. 72931/10, § 129, 9 April 2019, and Nazarenko v. Russia, no. 39438/13, § 66, ECHR 2015 (extracts)). - EGMR, 10.01.2023 - 35967/19
BORTOLATO c. ITALIE
France (no 19511/16, § 50, 12 novembre 2020), V.D. et autres c. - EGMR, 29.11.2022 - 9825/21
