    Auszug aus EGMR, 16.01.2024 - 76619/11
REMAINING COMPLAINTS 25. Having regard to the facts of the case, the submissions of the parties and its findings above, the Court considers that it has dealt with the main legal questions raised by the case and that there is no need to examine the remaining complaints under Article 6 § 1 of the Convention concerning the right to a reasoned judgment in respect of the remainder of the applicant's convictions, the principle of equality of arms as regards the admission and assessment of evidence by the courts and an alleged breach of his presumption of innocence under Article 6 § 2 of the Convention (see Centre for Legal Resources on behalf of Valentin Câmpeanu v. The Court further reiterates that the most appropriate form of redress would be a retrial in accordance with the requirements of Article 6 of the Convention, should the applicant so request (see Süleyman v. Turkey, no. 59453/10, § 110, 17 November 2020).

However, the trial court failed to establish whether the applicant had been aware of those instructions or had acted in accordance with any specific instructions given by the PKK (compare also Gülcü v. Turkey, no. 17526/10, § 112, 19 January 2016).
