Given that Article 494 §(ë) of the Code of Civil Procedure provides for such possibility, an appropriate form of redress for the violation of the applicant's right would be to reopen the proceedings, should the applicant request such reopening, and to re-examine the case in a manner that is in keeping with the requirements of the Convention (see Pálka and Others v. the Czech Republic, no. 30262/13, § 69, 24 March 2022, and Khizanishvili and Kandelaki, § 63, cited above).
