As regards the applicant's NI number the Government submit that, unlike in the case of B. v. France (Eur. Court HR, judgment of 1991, Series A no. 232-C), an employer is unable to establish the sex of the applicant from the NI number itself since it does not contain any encoded reference to her sex.
