As regards the conduct of the competent authority, the Government refer to the Guincho case in which the Court decided that delays could be justified if the courts were not able to cope with the sharply increasing number of cases (Eur. In view of the consistent practice of the European Court of Human Rights, according to which delays cannot entail responsibility of the State if the latter takes immediate and appropriate remedial action (cf. judgment of Zimmermann and Steiner of 13 July 1983, Series A no. 66), the Government submit that the delay that has occurred is a result of the complexity of the case and that the competent authorities took all possible measures to expedite the preparation of the written reasons of the judgment (exemption from new business; monitoring by the supervisory authority; disciplinary measures).
