    The applicant has in mind that Ernest Major Kirkwood (No. 10479/83 Dec. 12.3.84, D.R. 37 p. 158) who was returned to the United States by the United Kingdom on 15 March 1983, has had various pre-trial motions to avoid trial for Capital Murder rejected by the Superior and Appeal Courts.

    "According to the Commission case law concerning cases of extradition under Article 3 of the Convention, the only factor which is relevant is the existence of an objective danger for the person extradited" (No. 10479/83, Dec. 12.3.84, D.R. 37 p. 183).
