The Commission recalls that the Convention organs have found on several occasions that Contracting States enjoy a wide discretion in regulating planning matters (cf. Eur. Court H.R., Sporrong and Lönnroth judgment of 23 September 1982, Series A no. 52, p. 26, para. 69, and, in the context of United Kingdom legislation, Chater v. the United Kingdom, No. 11723/85, Dec. 7.5.87, D.R. 52 p. 250, 256).The Commission must determine whether, whilst recognising the wide margin of appreciation afforded to States in planning matters, a fair balance was struck between the general interest of the community and the protection of the individual's fundamental rights (cf. Chater v. the United Kingdom, No. 11723/85, referred to above).
