As regards the applicability of Article 6 (Art. 6), the Government submit that the contested proceedings concern a public-law claim, which is not comparable to claims under the law of damages, as it is neither dependent on the misconduct of a public servant nor on any other violation of the law (B. v. Austria No. 9661/82, Dec. 14.7.83, D.R. 34 p. 127).
