In this respect the Commission recalls that not only substantive rights under Section I of the Convention or its Protocols but also Article 25 (Art. 25) of the Convention, which confers upon individuals and non- governmental organisations a right of a procedural nature, must be interpreted as guaranteeing rights which are practical and effective as opposed to theoretical and illusory (see Eur. Court HR, Cruz Varas and Others v. Sweden judgment of 20 March 1991, Series A no. 201, p. 36, para. 99).
