1 (art. 6-1), as the Court had recognised in its judgments in Funke v. France (25 February 1993, Series A no. 256-A, p. 22, para. 44) and John Murray v. the United Kingdom (8 February 1996, Reports of Judgments and Decisions 1996-I, p. 49, para. 45), was the right of an individual not to be compelled to contribute incriminating evidence to be used in a prosecution against him.The wording of this paragraph in the John Murray judgment - especially if compared to that in paragraph 44 of the Funke v. France judgment of 25 February 1993 (Series A no. 256-A, p. 22, para. 44) - clearly suggests that, in the Court's opinion, two separate immunities are involved.

Moreover the Commission in Saunders v. the United Kingdom (report of the Commission of 10 May 1994, paras. 71-73) and the Court in Funke v. France (judgment of 25 February 1993, Series A no. 256-A, p. 22, para. 44) have accepted that they are an inherent part of the right to a fair hearing under Article 6 (art. 6).This Court in its judgment in Funke v. France (Series A no. 256-A) said that "the special features of customs law... cannot justify... an infringement of the right of anyone "charged with a criminal offence", within the autonomous meaning of this expression in Article 6 (art. 6), to remain silent and not to contribute to incriminating himself" (p. 22, para. 44).

In any event, Article 6 of the Convention can be applicable to cases of compulsion to give evidence even in the absence of any other proceedings, or where an applicant is acquitted in the underlying proceedings (Funke v. Ireland, no. 34720/97, §§ 43-45, ECHR 2000-XII).First, there are cases relating to the use of compulsion for the purpose of obtaining information which might incriminate the person concerned in pending or anticipated criminal proceedings against him, in other words, in respect of an offence with which that person has been "charged" within the autonomous meaning of Article 6 § 1 (see Funke v. France, judgment of 25 February 1993, Series A no. 256-A, p. 22, § 44; Heaney and McGuinness, cited above, §§ 55-59; and J.B., cited above, §§ 66-71).
