JOHNSTON AND OTHERS v. IRELAND
- EGMR, 20.11.1989 - 10572/83
MARKT INTERN VERLAG GMBH ET KLAUS BEERMANN c. ALLEMAGNE

./. Schweiz vom 28. März 1990, Serie A Band 173, S. 26, Nr. 68; Urteil Autronic AG ./. Schweiz vom 22. Mai 1990, Serie A Band 178, S. 25, Nr. 56; Urteil Stocké ./. Deutschland vom 19. März 1991, Serie A Band 199, S. 19, Nr. 54; und Öcalan ./ Türkei [GK], Individualbeschwerde Nr. 46221/99, Nr. 90, ECHR 2005-IV). - EGMR, 22.05.1990 - 12726/87
AUTRONIC AG v. SWITZERLAND
The Court has, moreover, already held on three occasions that it is applicable to profit-making corporate bodies (see the Sunday Times judgment of 26 April 1979, Series A no. 30, the Markt Intern Verlag GmbH and Klaus Beermann judgment of 20 November 1989, Series A no. 165, and the Groppera Radio AG and Others judgment of 28 March 1990, Series A no. 173).It is unnecessary to consider this submission and, therefore, to rule on the applicability of the third sentence of Article 10 § 1 (art. 10-1) in the instant case; at all events, that sentence "does not... provide that licensing measures shall not otherwise be subject to the requirements of paragraph 2 (art. 10-2), for that would lead to a result contrary to the object and purpose of Article 10 (art. 10) taken as a whole", as the Court pointed out in its Groppera Radio AG and Others judgment of 28 March 1990 (Series A no. 173, p. 24, § 61).
Having regard to the particular public for which they are intended, these enactments are sufficiently accessible (see paragraphs 34 and 36 above and the Groppera Radio AG and Others judgment previously cited, Series A no. 173, p. 26, § 68).
But we note that in the instances mentioned in the judgment (The Sunday Times, Series A no. 30; Markt Intern Verlag GmbH and Klaus Beermann, Series A no. 165, and Groppera Radio AG and Others, Series A no. 173) the content of the information which the company wished to disseminate was of some significance to it or to the intended recipients.
[ï?ª] Note by the Registrar: Case no. 14/1988/158/214.

INFORMATIONSVEREIN LENTIA AND OTHERS v. AUSTRIA
1 (art. 61).

CENTRO EUROPA 7 S.R.L. AND DI STEFANO v. ITALY
The applicants submitted that in accordance with the Court's case-law (referring to Glas Nadezhda EOOD and Anatoliy Elenkov v. Bulgaria, no. 14134/02, § 41, 11 October 2007, and Groppera Radio AG and Others v. Switzerland, 28 March 1990, § 49, Series A no. 173), the sole shareholder and statutory representative of a company could also be regarded as a victim of a prohibition on broadcasting. - EGMR, 29.10.1992 - 14234/88
OPEN DOOR AND DUBLIN WELL WOMAN v. IRELAND
In the Groppera Radio AG and Others v. Switzerland judgment of 28 March 1990 (Series A no. 173, p. 26, para. 68) the Court determined that "the scope of the concepts of foreseeability and accessibility depends to a considerable degree on the content of the instrument in issue, the field it is designed to cover and the number and status of those to whom it is addressed". - EGMR, 24.02.1994 - 15450/89
CASADO COCA v. SPAIN
Article 10 (art. 10) does not apply solely to certain types of information or ideas or forms of expression (see the markt intern Verlag GmbH and Klaus Beermann v. Germany judgment of 20 November 1989, Series A no. 165, p. 17, para. 26), in particular those of a political nature; it also encompasses artistic expression (see the Müller and Others v. Switzerland judgment of 24 May 1988, Series A no. 133, p. 19, para. 27), information of a commercial nature (see the markt intern Verlag GmbH and Klaus Beermann judgment previously cited, ibid.) - as the Commission rightly pointed out - and even light music and commercials transmitted by cable (see the Groppera Radio AG and Others v. Switzerland judgment of 28 March 1990, Series A no. 173, p. 22, paras. 54-55). - EGMR, 26.10.2000 - 30985/96
HASSAN ET TCHAOUCH c. BULGARIE
The level of precision required of domestic legislation which cannot in any case provide for every eventuality depends to a considerable degree on the content of the instrument in question, the field it is designed to cover and the number and status of those to whom it is addressed (see the above cited Hashman and Harrup judgment, ' 31, and the Groppera Radio AG and Others v. Switzerland judgment of 28 March 1990, Series A no. 173, p. 26, ' 68). - EGMR, 26.04.1995 - 15974/90
PRAGER ET OBERSCHLICK c. AUTRICHE
47). - EGMR, 15.11.1996 - 17862/91
CANTONI c. FRANCE
The Court recalls that the scope of the notion of foreseeability depends to a considerable degree on the content of the text in issue, the field it is designed to cover and the number and status of those to whom it is addressed (see the Groppera Radio AG and Others v. Switzerland judgment of 28 March 1990, Series A no. 173, p. 26, para. 68). - VG Würzburg, 16.10.1995 - W 8 K 94.1015
