    Das Gesuch der Klägerin, die Vorsitzende der 5. Kammer des Sozialgerichts Hildesheim, Frau Richterin am Verwaltungsgericht B., in dem Klageverfahren S 5 R 315/10 wegen Befangenheit abzulehnen, wird zurückgewiesen.

    Hiergegen hat die Klägerin unter dem 19. Juli 2010 Klage vor dem Sozialgericht (SG) Hildesheim erhoben, die dort am 20. Juli 2010 eingegangen ist und unter dem Aktenzeichen S 5 R 315/10 geführt wird.

    Frau Richterin am Verwaltungsgericht B. ist im Wege der Abordnung am SG Hildesheim tätig und damit nach den gesetzlichen sowie nach den Vorgaben des maßgeblichen Geschäftsverteilungsplanes zur Führung und (etwaigen) Entscheidung des von der Klägerin unter dem Aktenzeichen S 5 R 315/10 anhängig gemachten Rechtsstreits befugt und verpflichtet.

    Als die Klägerin am 20. Juli 2010 Klage vor dem SG Hildesheim unter dem Aktenzeichen S 5 R 315/10 erhoben hatte, war das vom Gesetzgeber für die erhobene Anfechtungs- und Leistungsklage vorgeschriebene Vorverfahren (Widerspruchsverfahren) nach § 78 SGG noch nicht durchgeführt.
