    2.20 The appellant has cited the judgments of the European Court of Human Rights in the cases of Rodrigues da Silva [and Hoogkamer v. the Netherlands, no. 50435/99, ECHR 2006-I], Said Botan [v. the Netherlands (striking out), no. 1869/04, 10 March 2009] and Ibrahim Mohamed [v. the Netherlands (striking out), no. 1872/04, 10 March 2009].

    According to the case-law of the European Court of Human Rights (Rodrigues da Silva and Hoogkamer v. the Netherlands [no. 50435/99, ECHR 2006-I]), where family life has started while no residence permit for that purpose has been granted, removal will lead to a violation of Article 8 only in the most exceptional circumstances.

    Nachzug zu einem subsidiär Schutzberechtigten bei Eheschließung nach Verlassen

    Ebenso wenig begründet er eine generelle Verpflichtung des Staates, die Wahl des Familienwohnsitzes durch ein verheiratetes Paar zu respektieren und Ehegatten, die nicht die deutsche Staatsangehörigkeit besitzen, zur Niederlassung zu akzeptieren (vgl. EGMR, Urteil vom 28. Mai 1985 - Nr. 9214/80, 9473/81 und 9474/81, Abdulaziz, Cabales und Balkandali/Vereinigtes Königreich - Rn. 68) bzw. eine Familienzusammenführung auf seinem Gebiet zu gestatten (BVerfG, Beschluss vom 12. Mai 1987 - 2 BvR 1226/83, 101/84, 313/84 - BVerfGE 76, 1 ; vgl. EGMR, Urteil vom 28. Juni 2011 - Nr. 55597/09, Nunez/Norwegen - Rn. 70 und EGMR , Urteil vom 3. Oktober 2014 - Nr. 12738/10, Jeunesse/Niederlande - Rn. 107).

    Als private Interessen sind in die Abwägung einzustellen unter anderem das Ausmaß, in dem das Familienleben bei einer Versagung des Zuzugs tatsächlich unterbrochen würde, das Ausmaß der Bindungen im Bundesgebiet wie auch im Herkunftsstaat bzw. in einem aufnehmenden Drittstaat, insbesondere die Dauer des Aufenthalts der jeweiligen Familienangehörigen, der aufenthaltsrechtliche Status (vgl. EGMR, Urteil vom 26. April 2007 - Nr. 16351/03, Konstatinov/Niederlande - Rn. 49 und EGMR , Urteil vom 3. Oktober 2014 - Nr. 12738/10, Jeunesse/Niederlande - Rn. 108), eine etwaige wirtschaftliche (vgl. EGMR, Urteil vom 26. April 2007 - Nr. 16351/03, Konstatinov/Niederlande - Rn. 49), soziale, kulturelle und sprachliche (vgl. EGMR , Urteil vom 21. September 2016 - Nr. 38030/12, Khan/Deutschland - Rn. 40) Integration im Bundesgebiet und das Bestehen etwaiger (unüberwindbarer) rechtlicher oder tatsächlicher Hindernisse für ein Leben der Familie in ihrem Herkunftsland oder in einem aufenthaltsgewährenden Drittland (vgl. EGMR, Entscheidung vom 8. März 2016 - Nr. 25960/13, I.A.A. u.a./Vereinigtes Königreich - Rn. 43 ff. und Urteil vom 8. November 2016 - Nr. 56971/10, El Ghatet/Schweiz - Rn. 45).

    Das Ergebnis der normativ zu ermöglichenden Abwägung muss einen fairen Ausgleich der widerstreitenden öffentlichen und privaten Interessen widerspiegeln (vgl. EGMR , Urteil vom 3. Oktober 2014 - Nr. 12738/10, Jeunesse/Niederlande - Rn. 121).

    Sind minderjährige Kinder betroffen, so ist deren Wohl in den Mittelpunkt der Überlegungen zu stellen und vorrangig zu berücksichtigen (vgl. EGMR , Urteil vom 3. Oktober 2014 - Nr. 12738/10, Jeunesse/Niederlande - Rn. 109 und EGMR, Urteil vom 8. November 2016 - Nr. 56971/10, El Ghatet/Schweiz - Rn. 46).

    Zu den insoweit besonders zu beachtenden Umständen zählen deren Alter, ihre Situation in dem Aufenthaltsland und das Ausmaß, in dem sie von ihren Eltern abhängig sind (vgl. EGMR , Urteil vom 3. Oktober 2014 - Nr. 12738/10, Jeunesse/Niederlande - Rn. 118).

    Einzustellen ist überdies, ob und unter welchen Umständen ein Elternteil unwiderruflich beschlossen und bewusst entschieden hat, seine Familienangehörigen im Herkunftsland oder in einem aufnehmenden Drittstaat zurückzulassen (EGMR, Urteil vom 21. Dezember 2001 - Nr. 31465/96, Sen/Niederlande - Rn. 39), inwieweit dadurch jede Absicht auf zukünftige Familienzusammenführung aufgegeben worden ist, sowie ob das Familienleben zu einer Zeit begründet wurde, zu der den beteiligten Personen bekannt war, dass die Aufnahme wegen des Aufenthaltsstatus des Stammberechtigten von Beginn an unsicher war (vgl. EGMR, Urteil vom 28. Juni 2011 - Nr. 55597/09, Nunez/Norwegen - Rn. 70 und EGMR , Urteil vom 3. Oktober 2014 - Nr. 12738/10, Jeunesse/Niederlande - Rn. 108).

Oktober 2014 - Nr. 12738/10, Jeunesse/Niederlande - Rn. 107 und vom 28. Juni 2011 - Nr. 55597/09, Nunez/Norwegen - Rn. 70).

    Das Ergebnis der Abwägung muss einen fairen Ausgleich der widerstreitenden öffentlichen und privaten Interessen widerspiegeln (EGMR, Urteil vom 3. Oktober 2014 - Nr. 12738/10, Jeunesse/Niederlande - Rn. 121).

    Besondere Bedeutung ist dem Umstand beizumessen, ob das Familienleben zu einer Zeit geschaffen wurde, zu der den beteiligten Personen bekannt war, dass die Aufnahme in dem Konventionsstaat wegen des Einwanderungsstatus eines Familienangehörigen von Beginn an unsicher war (EGMR, Urteile vom 28. Juni 2011 - Nr. 55597/09, Nunez/Norwegen - Rn. 70 und vom 3. Oktober 2014 - Nr. 12738/10, Jeunesse/Niederlande - Rn. 108).

    Zu berücksichtigen ist überdies, ob das Familienleben zu einer Zeit begründet wurde, zu der den beteiligten Personen bekannt war, dass die Aufnahme wegen des Aufenthaltsstatus des Stammberechtigten von Beginn an unsicher war (vgl. EGMR, Urteil vom 28. Juni 2011 - Nr. 55597/09, Nunez/Norwegen - Rn. 70 und EGMR , Urteil vom 3. Oktober 2014 - Nr. 12738/10, Jeunesse/Niederlande - Rn. 108).

    Voraussetzungen für den Familiennachzug zu subsidiär Schutzberechtigten

    Weder Art. 6 GG noch Art. 8 EMRK vermitteln einen unmittelbaren Anspruch auf Familienzusammenführung (BVerfG, Beschluss vom 18. Juli 1979 - 1 BvR 650/77 - BVerfGE 51, 386 ; EGMR , Urteil vom 3. Oktober 2014 - Nr. 12738/10, Jeunesse v. the Netherlands - Rn. 107).

    Erforderlich ist eine Einzelfallbetrachtung, bei der die familiären Bindungen, aber auch sonstige Umstände wie die Trennungsdauer oder die Möglichkeit der Herstellung der Familieneinheit nur im Bundesgebiet, abzuwägen sind (vgl. EGMR , Urteil vom 3. Oktober 2014 - Nr. 12738/10 - Rn. 106; BVerfG, Kammerbeschlüsse vom 10. Mai 2008 - 2 BvR 588/08 - InfAuslR 2008, 347 , vom 5. Juni 2013 - 2 BvR 586/13 - NVwZ 2013, 1207 und vom 9. Dezember 2021 - 2 BvR 1333/21 - NVwZ 2022, 406 Rn. 45).
