Par un arrêt du 23 mars 1995 sur diverses exceptions préliminaires soulevées par le gouvernement turc (série A no 310), la Cour a rejeté une exception concernant l'abus allégué de la procédure et dit que les faits allégués par la requérante étaient de nature à relever de la "juridiction" de la Turquie au sens de l'article 1 de la Convention (art. 1) et que les restrictions territoriales dont sont assorties les déclarations de la Turquie relatives aux articles 25 et 46 de la Convention (art. 25, art. 46) n'étaient pas valides mais que ces déclarations renfermaient des acceptations valides de la compétence de la Commission et de la Cour.Le texte intégral de l'avis de la Commission et des trois opinions séparées dont il s'accompagne figure en annexe à l'arrêt Loizidou c. Turquie du 23 mars 1995 (exceptions préliminaires), série A no 310.
La Cour doit maintenant examiner cette allégation puisque dans l'arrêt précité, elle a décidé de joindre au fond les questions soulevées par l'exception d'incompétence ratione temporis (arrêt Loizidou c. Turquie du 23 mars 1995 (exceptions préliminaires), série A no 310, pp.
Ainsi qu'il a été expliqué et décidé dans l'arrêt Loizidou sur les exceptions préliminaires (23 mars 1995, série A no 310), la Turquie peut avoir à répondre d'actes concrets perpétrés par les troupes et les fonctionnaires turcs dans le nord de Chypre.

Par un arrêt du 23 mars 1995 sur diverses exceptions préliminaires soulevées par le gouvernement turc (série A no 310), la Cour a rejeté une exception concernant l'abus allégué de la procédure et dit que les faits allégués par la requérante étaient de nature à relever de la "juridiction" de la Turquie au sens de l'article 1 de la Convention (art. 1) et que les restrictions territoriales dont sont assorties les déclarations de la Turquie relatives aux articles 25 et 46 de la Convention (art. 25, art. 46) n'étaient pas valides mais que ces déclarations renfermaient des acceptations valides de la compétence de la Commission et de la Cour.Le texte intégral de l'avis de la Commission et des trois opinions séparées dont il s'accompagne figure en annexe à l'arrêt Loizidou c. Turquie du 23 mars 1995 (exceptions préliminaires), série A no 310.
La Cour doit maintenant examiner cette allégation puisque dans l'arrêt précité, elle a décidé de joindre au fond les questions soulevées par l'exception d'incompétence ratione temporis (arrêt Loizidou c. Turquie du 23 mars 1995 (exceptions préliminaires), série A no 310, pp.
Ainsi qu'il a été expliqué et décidé dans l'arrêt Loizidou sur les exceptions préliminaires (23 mars 1995, série A no 310), la Turquie peut avoir à répondre d'actes concrets perpétrés par les troupes et les fonctionnaires turcs dans le nord de Chypre.
Le rôle et la responsabilité des organes de la Convention européenne, confrontés à de telles difficultés, correspond bien à l'engagement solidaire des Etats membres d'assurer la meilleure et la plus large protection des personnes et des droits fondamentaux dans les pays concernés par l'application conforme des dispositions de la Convention." 1) Premièrement, le présent arrêt comporte de graves erreurs méthodologiques: comme je l'ai déjà dit dans mon opinion dissidente sur les exceptions préliminaires de la même affaire (arrêt du 23 mars 1995, série A no 310), le problème juridique central de l'affaire Loizidou c. Turquie est celui de la juridiction et de la responsabilité au sens de la Convention.

Qui plus est, seul le gouvernement cypriote est reconnu au plan international comme le gouvernement de la République de Chypre dans le cadre des relations diplomatiques et contractuelles et dans le fonctionnement des organisations internationales (voir les décisions de la Commission sur la recevabilité des requêtes nos 6780/74 et 6950/75, Chypre c. Turquie, 26 mai 1975, D. R. 2, pp. 148-149, et no 8007/77, Chypre c. Turquie, 10 juillet 1978, D. R. 13, p. 220).D'abord, il rappelle la jurisprudence de la Commission qui limite la juridiction de la Turquie "à la zone frontalière et non à l'ensemble du nord de Chypre sous la mainmise des autorités cypriotes turques" (voir les décisions de la Commission sur la recevabilité des requêtes nos 6780/74, 6950/75 et 8007/77, citées au paragraphe 42 ci-dessus).
Il est à noter également que la Commission a limité sa prise en compte d'une juridiction de la Turquie à la zone frontalière et non à l'ensemble du nord de Chypre (requêtes nos 6780/74, 6950/75 et 8007/77) et que par ailleurs elle a constaté que l'arrestation, la détention et le procès des requérants dans les affaires précitées ne constituaient pas des actes imputables à la Turquie (paragraphe 51 de l'arrêt et paragraphe 114 du mémoire du gouvernement turc).
Dans sa décision du 26 mai 1975, concernant la requête Chypre c. Turquie (nos 6780/74 et 6950/75), la Commission s'était déjà prononcée dans le même sens (D. R. 2, p. 150).

On pourrait d'ailleurs distinguer la présente affaire de la cause Papamichalopoulos et autres c. Grèce - dans laquelle la Cour a constaté par son arrêt du 24 juin 1993 (série A no 260-B) qu'il y avait eu une ingérence continue dans les droits de propriété des requérants -, au motif que le gouvernement grec n'y a soulevé aucune exception ratione temporis.La Cour rappelle qu'elle a souscrit à la notion de violation continue de la Convention et à ses effets sur les limites temporelles à la compétence des organes de la Convention (voir, entre autres, les arrêts Papamichalopoulos et autres c. Grèce du 24 juin 1993, série A no 260-B, pp. 69-70, paras. 40 et 46, et Agrotexim et autres c. Grèce du 24 octobre 1995, série A no 330-A, p. 22, par. 58).
Dans l'hypothèse d'une détention carcérale qui a commencé avant et s'est poursuivie après la date décisive, ou dans celle de terrains illégalement occupés avant et après ladite date (comme dans l'affaire Papamichalopoulos et autres c. Grèce, arrêt du 24 juin 1993, série A no 260-B), il ne fait aucun doute que la période postérieure relève de la juridiction de la Cour.
