    Die Frist beginnt dann nämlich an jedem Tag erneut und erst wenn die zu Grunde liegende Verletzung beendet ist, beginnt tatsächlich die letzte Frist von sechs Monaten (Urteil vom 18. September 2009 - 16064/90 u.a. -, NVwZ-RR 2011, 251).

    Dies kann etwa der Fall sein, wenn ein Staat fortdauernd gegen die Pflicht verstößt, das Verschwinden von Personen aufzuklären (EGMR, Urteil vom 18. September 2009 - 16064/90 u.a. -, a. a. O.), bei konventionswidriger Haft (vgl. Karpenstein/Mayer, a. a. O., Art. 35 Rn. 54) oder der andauernden Verweigerung des Zugangs zum oder der Nutzung von Eigentum (vgl. Entscheidung vom 7. Oktober 2008 - 47550/06 -, a. a. O.) Angesichts dessen, dass mit dem Abschluss eines Gerichtsverfahrens auch eine auf dessen Dauer zurückzuführende Verletzung des Art. 6 EMRK abgeschlossen ist, mögen zwar die Auswirkungen der unangemessenen Verfahrensdauer noch fortwirken, die Verletzung an sich dauert aber mit dem Ende des Verfahrens nicht mehr an.

    Zwar beginnt die Frist des Art. 35 Abs. 1 EMRK in dem Fall, wenn ein Beschwerdeführer einen nur vermeintlich effektiven Rechtsbehelf ergreift, erst mit dem Zeitpunkt, an dem er von den Umständen, die zur Ineffektivität des Rechtsbehelfs führen, Kenntnis hatte oder hätte haben müssen, (EGMR, Entscheidung vom 01.02.2000, Nr. 28293/95 - Aydin u.a., in: FamRZ 2000, 1077; EGMR, Entscheidung vom 18.09.2009, Nr. 16064/90 Varnava u.a. , u.a. = NVwZ-RR 2011, 251, Rn. 157; Karpenstein/Mayer/Mayer , a.a.O., Art. 35, Rn. 55).

    Il s'agissait d'affaires s'inscrivant dans le cadre de durs combats politiques, mettant surtout en cause des personnes connues du public et ayant des convictions politiques particulières (Koku c. Turquie, no 27305/95, § 132-133, 31 mai 2005), ou qui avaient été placées en garde à vue avant de disparaître (OsmanoÄŸlu c. Turquie, no 48804/99, §§ 75-76, 24 janvier 2008), ou qui avaient fait l'objet de menaces avant leur disparition (Gongadzé c. Ukraine, no 34056/02, § 166, CEDH 2005-XI), ou qui avaient disparu alors que se déroulaient de violents conflits (Medova c. Russie, no 25385/04, §§ 97-100, CEDH 2009-... (extraits), Varnava et autres c. Turquie [GC], nos 16064/90, 16065/90, 16066/90, 16068/90, 16069/90, 16070/90, 16071/90, 16072/90 et 16073/90, § 191, CEDH 2009-....).

    Insoweit ist hier derselbe Rechtsgedanke maßgeblich, der die Rechtsprechung sowohl des EGMR als auch des Interamerikanischen Gerichtshofs für Menschenrechte leitet, wonach das Verschwindenlassen einer Person und die dadurch bei den Familienangehörigen ausgelösten Ängste eine grausame und erniedrigende Behandlung der Familienangehörigen darstellt (EGMR, 18.09.2009 - Nr. 16064/90 - "Varnava u.a. gegen Türkei", TZ 198ff., http://hudoc.echr.coe.int; IAGMR, Urt. v. 24.02.2011 - "Gelman v.     They argued that the same held true in this case, in particular as there was no reason why the first applicants in this case were not presumed to be dead as in other disappearance cases (e.g. Akdeniz and Others v. Turkey, no. 23954/94, 31 May 2001).

    The inter-State case concerned the phenomenon of disappearances, which, although linked to a specific point of time when the missing person was last seen and the surrounding circumstances, may be distinguished from conventional cases of use of lethal force or unlawful killings which are dealt with under Article 2. In the latter cases, the fate of the victim is known; the former are characterised by an ongoing situation of uncertainty and, not infrequently, callous inaction, obfuscation and concealment (see, amongst many examples, Kurt v. Turkey, judgment of 25 May 1998, Reports of Judgments and Decisions 1998-III, §§ 127-128, Timurtas v. Turkey, no. 23531/94, §§ 84, 97, ECHR 2000-VI § 84, 97, Akdeniz and Others v. Turkey, no. 23954/94, § 93, 31 May 2001, Tas v. Turkey, no. 24396/94, §§ 80, 90, 14 November 2000; Imakeyeva v. Russia, §§ 150 165, 9 November 2006, Baysayeva v. Russia, §§ 119, 127 April 2007).

    While it may be noted that in the context of the individual cases arising out of events in south-east Turkey and the conflict in the Chechen Republic, where there were, at the relevant times, numerous reported instances of forced disappearances, individual applicants have nonetheless been required to give an evidential basis for finding that their relatives were taken into some form of custody by agents of the State (see e.g. Kurt v. Turkey, judgment of 25 May 1998, Reports of Judgments and Decisions 1998-III, § 99, Akdeniz and Others v. Turkey, no. 23954/94, § 84, 31 May 2001, Sarli v. Turkey, 24490/94, 22 May 2001; Imakayeva v. Russia, no. 7615/02, § 141, ECHR 2006-... (extracts)), the Court considers that the situation in the present case may be distinguished.
