GU?MUNDUR GUNNARSSON AND MAGN?S DAV?? NOR?DAHL v. ICELAND
The existence of such a system is one of the essential guarantees of free and fair elections and is an important safeguard against arbitrariness in the electoral process (see Petkov and Others v. Bulgaria, nos. 77568/01 and 2 others, § 63, 11 June 2009). - VG Trier, 08.05.2012 - 1 K 1302/11
Finlande, no 27824/95, §§ 39-40, CEDH 2002-VII, Petkov c. Bulgarie (déc.), nos 77568/01, 178/02 et 505/02, 4 décembre 2007, et Meltex LTD c. Arménie (déc.), no 37780/02, 27 mai 2008).

- EGMR, 20.10.2011 - 5774/10
MANDIC AND JOVIC v. SLOVENIA
However, the remedy required by Article 13 must be effective in law as well as in practice (Petkov and Others v. Bulgaria, nos. 77568/01, 178/02 and 505/02, § 74, ECHR 2009-...). - EGMR, 25.10.2011 - 2033/04
VALKOV AND OTHERS v. BULGARIA
The Court has, in line with its earlier case-law on that point (see Brozicek v. Italy, 19 December 1989, § 34, Series A no. 167; Padovani v. Italy, 26 February 1993, § 20, Series A no. 257-B; Spadea and Scalabrino v. Italy, 28 September 1995, § 24, Series A no. 315-B; and Immobiliare Saffi, cited above, § 42 in fine), already held that the possibility to request the bodies or the officials entitled to bring such proceedings to do so is not an effective remedy for the purposes of Articles 13 or 35 § 1 of the Convention, because the persons concerned cannot directly compel the institution of proceedings before the Constitutional Court, whereas under this Court's settled case-law a remedy can be considered effective only if the applicant is able to initiate the procedure directly (see Petkov and Others v. Bulgaria, nos. 77568/01, 178/02 and 505/02, § 82, ECHR 2009-..., with further references). - EGMR, 07.10.2021 - 49529/12

ORAN c. TURQUIE
- EGMR, 19.06.2012 - 29400/05

and 72 et seq., that "the scope of the Contracting States" obligations under Article 13 varies depending on the nature of the applicant's complaint;... the remedy must be effective in practice as well as in law in the sense either of preventing the alleged violation or remedying the impugned state of affairs, or of providing adequate redress for any violation that has already occurred" (see Petkov and Others v. CHEMINADE v. FRANCE
Auszug aus EGMR, 04.12.2007 - 77568/01
The Court observes that proceedings concerning electoral disputes, in particular disputes over the right to stand for election, fall outside the scope of Article 6, in so far as they concern the exercise of political rights and do not, for this reason, have any bearing on "civil rights and obligations" within the meaning of that provision (see Priorello v. Italy, application no. 11068/84, Commission decision of 6 May 1985, Decisions and Reports (DR) 43, p. 195; Pierre-Bloch v.
