    The Court has also emphasised the right of all prisoners to conditions of detention which are compatible with human dignity, so as to ensure that the manner and method of execution of the measures imposed do not subject them to distress or hardship of an intensity exceeding the unavoidable level of suffering inherent in detention; in addition, besides the health of prisoners, their well-being also has to be adequately secured, given the practical demands of imprisonment (see Kudla v. Poland [GC], no. 30210/96, § 94, ECHR 2000-XI and Mouisel v. France, no. 67263/01, § 40, ECHR 2002-IX).

    Les conclusions du Comité européen pour la prévention de la torture (CPT) rendues à la suite des visites effectuées dans des prisons de Roumanie, tout comme les observations à caractère général du CPT, sont résumées dans l'arrêt Bragadireanu c. Roumanie (no 22088/04, §§ 73-76, 6 décembre 2007).

    Le requérant se réfère aux affaires similaires examinées par la Cour, où des requérants avaient séjourné des les mêmes centres de détention que lui, et dont les conditions de détention furent jugées contraires à l'article 3 de la Convention (Bragadireanu c. Roumanie, no 22088/04, § 60, 6 décembre 2007 ; Maciuca précité, § 24 et Viorel Burzo c. Roumanie, nos 75109/01 et 12639/02, §§ 46, 30 juin 2009).

    Le requérant renvoie à une affaire dans laquelle une demande similaire a été rejetée en 2005 comme irrecevable par les tribunaux internes (cf. Bragadireanu c. Roumanie, no 22088/04, §§ 62-63, 6 décembre 2007).

    Les textes pertinents du Conseil de l'Europe 44. Le 11 mars 2021, 1e Service de l'exécution des arrêts de la Cour, dans le cadre de la surveillance de l'exécution de l'arrêt pilote Rezmives et autres, précité, a évalué les mesures générales adoptées en exécution de 90 affaires roumaines concernant principalement la surpopulation et les conditions matérielles de détention dans les établissements pénitentiaires et les dépôts de police (groupe d'affaires Bragadireanu (no 22088/04) et Rezmives et autres (précité)).
