RIBITSCH c. AUTRICHE
Auszug aus EGMR, 09.06.1998 - 22496/93
The Court has assessed these facts against the standards imposed by Article 3. It recalls that, in respect of a person deprived of his liberty, recourse to physical force which has not been made strictly necessary by his own conduct diminishes human dignity and is in principle an infringement of the right set forth in Article 3 (see the Ribitsch v. Austria judgment of 4 December 1995, Series A no. 336, p. 26, § 38).It will be recalled that in the Ribitsch case the applicant had a medical examination both on the day of his release and the next day (see the judgment of 4 December 1995, Series A no. 336, p. 9, § 13).
