La Cour note que les garanties contenues à l'article 10 de la Convention valent pour les requérants, nonobstant leur statut de fonctionnaires employés par des collectivités locales (voir, mutatis mutandis, l'arrêt Vogt c. Allemagne du 26 septembre 1995, série A n° 323, p. 22, § 43 ; voir aussi le paragraphe 56 ci-dessous).L'évaluation des différents aspects et éléments de l'affaire doit - ainsi que le rappelle l'arrêt (paragraphe 55) - partir du principe suivant: la liberté d'expression constitue l'un des fondements essentiels d'une société démocratique, l'une des conditions primordiales de son progrès et de l'épanouissement de chacun ; par conséquent, afin justement de renforcer la société démocratique, la nécessité de restreindre cette liberté « doit se trouver établi[e] de manière convaincante'(arrêt Vogt c. Allemagne du 26 septembre 1995, série A n° 323, p. 25, § 52).

1 (Art. 11-1) of the Convention, of the right "to form and to join trade unions", and recalls that a trade union may claim to be a victim of alleged violations of its own rights (cf. Eur. Court HR, National Union of Belgian Police v. Belgium judgment of 27 October 1975, Series A no. 19, p. 18, para. 39), and that a trade union may be able to claim to be the victim of a violation of Article 11 (Art. 11) of the Convention where the right to join a trade union is completely removed (cf. No. 11603/85, Council of Civil Service Unions et al. v. the United Kingdom, Dec. 20.1.87, D.R. 50, p. 228, where the question of the union's standing was not expressly addressed; see also, as an example of a case where the union did not have such status, No. 22954/93, Ahmed and others v. the United Kingdom, Dec. 12.9.95).
