Auszug aus EGMR, 17.10.2013 - 26824/04
Unlike most of the substantive clauses of the Convention and its Protocols, Article 3 makes no provision for exceptions and no derogation from it is permissible under Article 15 § 2 even in the event of a public emergency threatening the life of the nation (see Selmouni v. France [GC], no. 25803/94, § 95, ECHR 1999-V, and Assenov and Others, cited above, § 93). - EGMR, 10.06.2010 - 16266/03
SHERSTOBITOV v. RUSSIA
Auszug aus EGMR, 17.10.2013 - 26824/04
However, having regard to its conclusions above under Article 2 of the Convention, the Court considers it unnecessary to examine those issues separately under Article 13 of the Convention (see, for example, Bekos and Koutropoulos v. Greece, no. 15250/02, § 57, ECHR 2005-XIII (extracts); Polonskiy v. Russia, no. 30033/05, § 127, 19 March 2009; Sherstobitov v. Russia, no. 16266/03, § 94, 10 June 2010; and Suleymanov v. Russia, no. 32501/11, § 157, 22 January 2013). - EGMR, 22.09.1993 - 15473/89
KLAAS c. ALLEMAGNE
Auszug aus EGMR, 17.10.2013 - 26824/04
Allegations of ill-treatment must be supported by appropriate evidence (see, mutatis mutandis, Klaas v. Germany, 22 September 1993, § 30, Series A no. 269).

SULEYMANOV v.
- EGMR, 19.03.2009 - 30033/05
POLONSKIY v.
- EGMR, 27.07.2004 - 57671/00
SLIMANI v. FRANCE
Auszug aus EGMR, 17.10.2013 - 26824/04
As a general rule, the mere fact that an individual dies in suspicious circumstances while in custody should raise an issue as to whether the State has complied with its obligation to protect that person's right to life (see Slimani v. France, no. 57671/00, § 27, ECHR 2004-IX (extracts)). - EGMR, 27.09.1995 - 18984/91
McCANN AND OTHERS v. THE UNITED KINGDOM
Auszug aus EGMR, 17.10.2013 - 26824/04
The Court reiterates that where a State or its agents potentially bear responsibility for a loss of a life, the events in question should be subject to an effective investigation or scrutiny which enables the facts to become known to the public and in particular to the relatives of any victims (see Sieminska v. Poland (dec.), no. 37602/97, 29 March 2001; see also McCann and Others v. the United Kingdom, 27 September 1995, § 161, Series A no. 324; and Ergi v. Turkey, 28 July 1998, § 82, Reports 1998-IV). - EGMR, 04.05.2001 - 24746/94
HUGH JORDAN v. THE UNITED KINGDOM
Auszug aus EGMR, 17.10.2013 - 26824/04
Such investigation must be initiated promptly and conducted with reasonable expedition (e.g. Hugh Jordan v. the United Kingdom, no. 24746/94, § 108, ECHR 2001-III (extracts)). - EGMR, 06.07.2005 - 43579/98

PAUL ET AUDREY EDWARDS c. ROYAUME-UNI
Auszug aus EGMR, 17.10.2013 - 26824/04
A positive obligation will arise, the Court has held, where it has been established that the authorities knew or ought to have known at the time of the existence of a real and immediate risk to the life of an identified individual by a third party or himself and that they failed to take measures within the scope of their powers which, judged reasonably, might have been expected to avoid that risk (see Keenan v. the United Kingdom, cited above, § 90; Paul and Audrey Edwards v. the United Kingdom, no. 46477/99, § 55, ECHR 2002-III). - EGMR, 13.06.2002 - 38361/97
ANGUELOVA v. BULGARIA
- EGMR, 30.06.2020 - 23405/16
S.F. c. SUISSE
En l'espèce, le geste anormal de D.F. ne dégage néanmoins pas l'État de son devoir découlant de l'article 2 de la Convention de protéger sa vie, en tant que personne détenue, contre des dangers prévisibles (Keller c. Russie, no 26824/04, § 90, 17 octobre 2013). - EGMR, 16.07.2015 - 12008/06
ALEKSEY BORISOV c. RUSSIE
Russie, no 72250/01, § 125, Beristain Ukar c. Espagne, no 40351/05, § 42, 8 mars 2011, et Keller c.
Russie, no 26824/04, §§ 54-61 et 67-73, 17 octobre 2013. - EGMR, 17.01.2023 - 84523/17
DARAIBOU v. CROATIA
However, even where it is not established that the authorities knew or ought to have known about any such risk, there are certain basic precautions which police officers and prison officers should be expected to take in all cases in order to minimise any potential risk to protect the health and well-being of the arrested person (see Fanziyeva v. Russia, no. 41675/08, § 48, 18 June 2015 ; Keller v. Russia, no. 26824/04, § 88, 17 October 2013; Eremiá?.ová and Pechová v. the Czech Republic, no. 23944/04, § 110, 16 February 2012; and Mi?¾igárová v. Slovakia, no. 74832/01, § 89, 14 December 2010). - EGMR, 17.10.2017 - 28008/14
KRIVOLUTSKAYA v. RUSSIA
The investigation must be capable of establishing the cause of the injuries and the identification of those responsible with a view to their punishment (see, Keller v. Russia, no. 26824/04, § 93, 17 October 2013).
