Sweden, no. 1813/07, § 54, 9 February 2012, which concerned allegations that homosexuals were attempting to play down paedophilia and were responsible for the spread of HIV and AIDS).By reason of Article 17, the applicants could not claim the protection of Article 10. The same approach has been taken by the Court in certain cases, notably Norwood v. the United Kingdom ((dec.), no. 23131/03, ECHR 2004-XI).

Diese Voraussetzungen entsprechen im Wesentlichen jenen, die der Europäische Gerichtshof für Menschenrechte (im Folgenden: EGMR) in seiner Rechtsprechung entwickelt hat, wonach ein Eingriff in das Recht auf freie Meinungsäußerung im Licht von Art. 10 Abs. 2 EMRK "gesetzlich vorgesehen" sein, eines oder mehrere der in dieser Vorschrift aufgezählten legitimen Ziele verfolgen und für das Erreichen dieses oder dieser Ziele "in einer demokratischen Gesellschaft erforderlich" sein muss (EGMR, 15. Oktober 2015, Perinçek/Schweiz, CE:ECHR:2015:1015JUD002751008, Rn. 124).Die Voraussetzung, dass das Gesetz Verstöße klar definieren muss, ist erfüllt, wenn der Rechtsunterworfene aufgrund des Wortlauts der betreffenden Vorschrift - nötigenfalls anhand ihrer Auslegung durch die Gerichte - erkennen kann, welche Handlungen und Unterlassungen seine Verantwortlichkeit begründen (vgl. in diesem Sinne EGMR, 15. Oktober 2015, Perinçek/Schweiz, CE:ECHR:2015:1015JUD002751008, Rn. 133 und 134).
Diese Freiheit unterliegt zwar Ausnahmen, diese sind jedoch eng auszulegen und die Erforderlichkeit, sie zu beschränken, muss überzeugend dargelegt werden (EGMR, 15. Oktober 2015, Perinçek/Schweiz, CE:ECHR:2015:1015JUD002751008, Rn. 196, Ziff. i).
Es liegt in der Natur des politischen Diskurses, dass er kontrovers und oft heftig geführt wird, gleichwohl liegt er im öffentlichen Interesse, außer wenn Grenzen überschritten werden und zu Gewalt, Hass oder Intoleranz aufgerufen wird (EGMR, 15. Oktober 2015, Perinçek/Schweiz, CE:ECHR:2015:1015JUD002751008, Rn. 197, 230 und 231).
Drittens hat der EGMR zur "Erforderlichkeit" einer Beschränkung der Meinungsfreiheit festgestellt, dass diese ein zwingendes gesellschaftliches Bedürfnis voraussetzt und dass ein Eingriff im Licht der gesamten Rechtssache geprüft werden muss, um festzustellen, ob er in einem angemessenen Verhältnis zu dem verfolgten legitimen Zweck steht und ob die von den Behörden zur Rechtfertigung angeführten Gründe stichhaltig und ausreichend erscheinen (EGMR, 15. Oktober 2015, Perinçek/Schweiz, CE:ECHR:2015:1015JUD002751008, Rn. 196, Ziff. ii und iii).

Auswärtige Beziehungen
Nach dieser Rechtsprechung sind Äußerungen, mit denen Gewalt, Hass, Fremdenfeindlichkeit oder andere Formen der Intoleranz verteidigt oder gerechtfertigt werden, anders als die besonders schützenswerten Äußerungen zu Fragen von öffentlichem Interesse in der Regel nicht geschützt (vgl. in diesem Sinne EGMR, 8. Juli 1999, Sürek/Türkei [Nr. 1], CE:ECHR:1999:0708JUD002668295, §§ 61 und 62, und 15. Oktober 2015, Perinçek/Schweiz, CE:ECHR:2015:1015JUD002751008, §§ 197 und 230).Der EGMR stellt zur Klärung der Frage, ob in den Äußerungen in ihrer Gesamtheit eine Rechtfertigung von Gewalt gesehen werden kann, auf die Wortwahl, die Art und Weise ihrer Formulierung sowie den Kontext ihrer Verbreitung ab (vgl. in diesem Sinne EGMR, 6. Juli 2010, Gözel und Özer/Türkei, CE:ECHR:2010:0706JUD004345304, § 52, und 15. Oktober 2015, Perinçek/Schweiz, CE:ECHR:2015:1015JUD002751008, §§ 205 und 206).

Aus dieser Rechtsprechung geht hervor, dass die Freiheit der Meinungsäußerung eine der wesentlichen Grundlagen einer demokratischen Gesellschaft und eine der wichtigsten Voraussetzungen für ihren Fortschritt und die Entfaltung jedes Einzelnen bildet und dass sie grundsätzlich nicht nur positiv aufgenommene oder als harmlos oder unwichtig angesehene "Informationen" oder "Ideen" schützt, sondern - um Pluralismus, Toleranz und Aufgeschlossenheit zu gewährleisten, ohne die es keine demokratische Gesellschaft gibt - auch solche, die verletzen, schockieren oder beunruhigen (EGMR, Urteil vom 15. Oktober 2015, Perinçek/Schweiz, CE:ECHR:2015:1015JUD002751008, § 196 i).Darüber hinaus hat der Europäische Gerichtshof für Menschenrechte hervorgehoben, dass Art. 10 Abs. 2 der Europäischen Konvention zum Schutz der Menschenrechte und Grundfreiheiten für Beschränkungen der Freiheit der Meinungsäußerung im politischen Diskurs oder in Fragen von allgemeinem Interesse kaum Raum lässt und dass in der Regel ein hohes Maß an Schutz der Freiheit der Meinungsäußerung gewährt wird, wenn die Äußerungen ein Thema von allgemeinem Interesse betreffen (EGMR, Urteil vom 15. Oktober 2015, Perinçek/Schweiz, CE:ECHR:2015:1015JUD002751008, §§ 196 i, 197, 230 und 231).
