November 2019 - 1 BvR 16/13 -, Rn. 69) für die Annahme bestehen, der Europäische Gerichtshof könnte der Charta eine Verpflichtung der Mitgliedstaaten entnehmen, die Grundrechtsberechtigung staatlicher Unternehmen und gemischtwirtschaftlicher Unternehmen mit überwiegender öffentlicher Beteiligung anzuerkennen, ist zweifelhaft.
