It is understood that it is not for the Court to pronounce as to what the actual outcome of the impugned domestic proceedings should have been (see, mutatis mutandis, Rakic and Others v. Serbia, nos. 47460/07 and 29 others, § 44, 5 October 2010) and noted that a lack of an oral hearing on 1 October 2008, in particular, was rendered moot by the Supreme Court's quashing judgment of the same date (see paragraph 15 above). - EGMR, 25.03.2014 - 17153/11
VUCKOVIC AND OTHERS v. SERBIA
On a number of previous occasions when examining applications lodged against the same respondent State, the Court has held that "a constitutional appeal should, in principle, be considered as an effective domestic remedy within the meaning of Article 35 § 1 of the Convention in respect of all applications introduced [against Serbia] as of 7 August 2008" (see Vincic, cited above, § 51; see also Rakic and Others v. LAKICEVIC AND OTHERS v. MONTENEGRO AND SERBIA
The Court recalls that it has already established that an appeal on points of law in civil proceedings (revizija) and an appeal on points of law in criminal proceedings (zahtjev za ispitivanje zakonitosti pravosnazne presude), are, in principle, effective domestic remedies within the meaning of Article 35 § 1 of the Convention (see, mutatis mutandis, Rakic and Others v. Serbia, nos. 47460/07 et seq., §§ 37 and 27, 5 October 2010, and the authorities cited therein; Debelic v. Croatia, no. 2448/03, §§ 20 and 21, 26 May 2005; and Mamudovski v. the former Yugoslav Republic of Macedonia (dec.), no. 49619/06, 10 March 2009).
