LABITA c. ITALIE
Auszug aus EGMR, 19.07.2007 - 36898/03
It prohibits in absolute terms torture or inhuman or degrading treatment or punishment, irrespective of the circumstances and the victim's behaviour (see Labita v. Italy [GC], no. 26772/95, § 119, ECHR 2000-IV). - EGMR, 27.06.2000 - 21986/93
Some of the applicant's allegations are not supported by sufficient evidence and, therefore, cannot be proved "beyond reasonable doubt", which is the Court's usual standard of proof (see Ireland v. the United Kingdom, judgment of 18 January 1978, Series A no. 25, pp. 64-65, § 161; see also, by contrast, Salman v. Turkey [GC], no. 21986/93, § 100, ECHR 2000-VII, where the Court held that the burden of proof may be reversed in particular circumstances). - EGMR, 19.04.2001 - 28524/95
PEERS v. GREECE
Auszug aus EGMR, 19.07.2007 - 36898/03
The Court has frequently found a violation of Article 3 of the Convention on account of the lack of personal space afforded to detainees (see Peers v. Greece, no. 28524/95, §§ 69 et seq., ECHR 2001-III; Khudoyorov v. Russia, no. 6847/02, §§ 104 et seq., ECHR 2005-X; Labzov v. Russia, no. 62208/00, §§ 44 et seq., 16 June 2005; Novoselov v. Russia, no. 66460/01, §§ 41 et seq., 2 June 2005; Mayzit v. Russia, no. 63378/00, §§ 39 et seq., 20 January 2005; and Kalashnikov v. Russia, no. 47095/99, §§ 97 et seq., ECHR 2002-VI).
- EGMR, 22.05.2001 - 33592/96
BAUMANN v. FRANCE
Auszug aus EGMR, 19.07.2007 - 36898/03
However, this rule is subject to exceptions, which may be justified by the particular circumstances of each case (see Baumann v. France, no. 33592/96, § 47, 22 May 2001). - EGMR, 24.07.2001 - 44558/98
VALASINAS v. LITHUANIA
Auszug aus EGMR, 19.07.2007 - 36898/03
The assessment of this minimum level of severity is relative; it depends on all the circumstances of the case, such as the duration of the treatment, its physical and mental effects and, in some cases, the sex, age and state of health of the victim (see Valasinas v. Lithuania, no. 44558/98, §§ 100-01, ECHR 2001-VIII). - EGMR, 06.09.2001 - 69789/01
BRUSCO v. ITALY
Auszug aus EGMR, 19.07.2007 - 36898/03
Thus, the Court has departed from this rule in a number of length-of-proceedings cases against Italy and Poland, where it rejected applications for non-exhaustion, referring to a remedy introduced after the application had been lodged before the Court (see Brusco v. Italy (dec.), no. 69789/01, ECHR 2001-IX, and Charzynski v. Poland (dec.), no. 15212/03, ECHR 2005-V). - EGMR, 15.07.2002 - 47095/99
Russland, Haftbedingungen, EMRK, Europäische Menschenrechtskonvention, …
Auszug aus EGMR, 19.07.2007 - 36898/03

Greece, no. 28524/95, §§ 69 et seq., ECHR 2001-III; Khudoyorov v. Russia, no. 6847/02, §§ 104 et seq., ECHR 2005-X; Labzov v. Russia, no. 62208/00, §§ 44 et seq., 16 June 2005; Novoselov v. MAYZIT v. RUSSIA
CHARZYNSKI c. POLOGNE
VARGA AND OTHERS v. HUNGARY
However, the Court has so far refrained from determining how much space should be allocated to a detainee in terms of the Convention, having considered that a number of other relevant factors, such as the duration of detention, the possibilities for outdoor exercise, the physical and mental condition of the detainee and so forth, play an important part in deciding whether the detention conditions complied with the guarantees of Article 3 of the Convention (see Trepashkin v. Russia, no. 36898/03, § 92, 19 July 2007; and Torreggiani and Others, cited above, § 69). - EGMR, 09.10.2008 - 62936/00
MOISEYEV v. RUSSIA
Thus, even in cases where a larger prison cell was at issue - measuring in the range of three to four sq.m per inmate - the Court found a violation of Article 3 since the space factor was coupled with the established lack of ventilation and lighting (see, for example, Babushkin v. Russia, no. 67253/01, § 44, 18 October 2007; Trepashkin v. Russia, no. 36898/03, § 94, 19 July 2007, and Peers v. Greece, no. 28524/95, §§ 70-72, ECHR 2001-III). - EGMR, 12.03.2009 - 15217/07
ALEKSANDR MAKAROV v. RUSSIA
Thus, even in cases where a larger prison cell was at issue - measuring in the range of three to four square metres per inmate - the Court found a violation of Article 3 since the space factor was coupled with the established lack of ventilation and lighting (see, for example, Vlasov v. Russia, no. 78146/01, § 84, 12 June 2008; Babushkin v. Russia, no. 67253/01, § 44, 18 October 2007; Trepashkin v. Russia, no. 36898/03, § 94, 19 July 2007; and Peers v. Greece, no. 28524/95, §§ 70-72, ECHR 2001-III).
- EGMR, 28.05.2014 - 41513/12
TSOKAS ET AUTRES c.
Italie, no 22635/02, 16 juillet 2009 ; Vlassov c. Russie, no 78146/01, 12 juin 2008 ; Babouchkine c. Russie, no 67253/01, 18 octobre 2007, et Trepachkine c. Russie, no 36898/03, 19 juillet 2007). - EGMR, 26.10.2010 - 17044/03
CUCOLAS c. ROUMANIE
Russie, no 78146/01, § 84, 12 juin 2008, Babouchkine c. Russie, no 67253/01, § 44, 18 octobre 2007, Trepachkine c. Russie, no 36898/03, § 94, 19 juillet 2007). - EGMR, 14.09.2010 - 37186/03
FLOREA c. ROUMANIE
Russie, no 78146/01, § 84, 12 juin 2008, Babouchkine c. Russie, no 67253/01, § 44, 18 octobre 2007, Trepachkine c. Russie, no 36898/03, § 94, 19 juillet 2007). - EGMR, 23.10.2014 - 36546/10
NIKOLAOS ATHANASIOU ET AUTRES c.
Russie, no 78146/01, § 84, 12 juin 2008, Babouchkine c. Russie, no 67253/01, § 44, 18 octobre 2007, Trepachkine c. Russie, no 36898/03, § 94, 19 juillet 2007, et Peers c. Grèce, no 28524/95, §§ 70-72, CEDH 2001-III). - EGMR, 10.12.2013 - 10511/10
MURRAY v. THE NETHERLANDS
Russie, no 5140/02, § 68, 25 octobre 2005, et Trepashkin c. Russie, no 36898/03, § 94, 19 juillet 2007). - EGMR, 11.10.2011 - 2889/09
TAGGATIDIS ET AUTRES c. GRECE
Russie, no 78146/01, § 84, 12 juin 2008, Babouchkine c. Russie, no 67253/01, § 44, 18 octobre 2007, Trepachkine c. Russie, no 36898/03, § 94, 19 juillet 2007, et Peers précité, §§ 70-72). - EGMR, 27.01.2009 - 1704/06
RAMISHVILI AND KOKHREIDZE v. GEORGIA
In the Peers case, an even bigger cell (7 square metres for two inmates) was considered a relevant factor in finding a violation, coupled, as in the present case, with a lack of ventilation and daylight (see Peers v. Greece, no. 28524/95, § 70-72, ECHR 2001-III, and Trepashkin v Russia, no. 36898/03, § 94, 19 July 2007). - EGMR, 25.02.2016 - 29769/13
