JACUBOWSKI v. GERMANY
Auszug aus EGMR, 05.11.2002 - 38743/97
However, the authorities' margin of appreciation is essential in an area as fluctuating as that of commercial broadcasting (see, mutatis mutandis, markt intern Verlag GmbH and Klaus Beermann v. Germany, judgment of 20 November 1989, Series A no. 165, pp. 19-20, § 33, and Jacubowski v. Germany, judgment of 23 June 1994, Series A no. 291-A, p. 14, § 26).Such a margin of appreciation is particularly important in commercial matters (see markt intern Verlag GmbH and Klaus Beermann v. Germany, judgment of 20 November 1989, Series A no. 165, pp. 19-20, § 33, and Jacubowski v. Germany, judgment of 23 June 1994, Series A no. 291-A, p. 14, § 26).

GROPPERA RADIO AG ET AUTRES c. SUISSE
Auszug aus EGMR, 05.11.2002 - 38743/97
This may lead to interferences whose aims will be legitimate under the third sentence of paragraph 1, even though they may not correspond to any of the aims set out in paragraph 2. The compatibility of such interferences with the Convention must nevertheless be assessed in the light of the other requirements of paragraph 2 (see Tele 1 Privatfernsehgesellschaft mbH v. Austria, no. 32240/96, § 25, 21 September 2000; Radio ABC v. Austria, judgment of 20 October 1997, Reports of Judgments and Decisions 1997-VI, pp. 2197-98, § 28; Informationsverein Lentia and Others, cited above, p. 14, § 32; and Groppera Radio AG and Others v. Auszug aus EGMR, 05.11.2002 - 38743/97
This requirement applied not only to technical aspects but also, as the Court had pointed out in Informationsverein Lentia and Others v. Austria, to other conditions, such as "the nature and objectives of a proposed station, its potential audience at national, regional or local level, [and] the rights and needs of a specific audience" (see judgment of 24 November 1993, Series A no. 276, p. 14, § 32).

Rundfunkfinanzierungsstaatsvertrag
HERBAI v. HUNGARY
It follows that, where commercial speech is concerned, the standards of scrutiny may be less severe (see, mutatis mutandis, Demuth v. Switzerland, no. 38743/97, §§ 41-42, ECHR 2002-IX, and markt intern Verlag GmbH and Klaus Beermann v. Germany, 20 November 1989, § 33, Series A no. 165); and the margin of appreciation afforded to the national authorities is broad (see Ashby Donald and Others v. France, no. 36769/08, § 39, 10 January 2013). - EGMR, 11.10.2007 - 14134/02
