ROWE AND DAVIS v. THE UNITED KINGDOM

    Auszug aus EGMR, 27.10.2004 - 39647/98
They pointed out that in Teixeira de Castro the Court had awarded pecuniary and non-pecuniary damages on the basis that the applicant's detention had resulted directly from the use of evidence obtained by agents provocateurs in breach of Article 6 § 1. Although the present applicants were unable to prove that their detention similarly resulted from unlawful entrapment, their inability to establish this link resulted directly from the breach of Article 6. Their cases were distinguishable from Rowe and Davis v. the United Kingdom ((GC), no. 28901/95, ECHR 2000-II), where the Court awarded no damages, because in Rowe and Davis the undisclosed evidence formed no part of the prosecution case against the applicants, whereas in the present case it formed part of the material on which the judges decided not to stay the prosecutions.

39647/98 and 40461/98, §§ 46-48, ECHR 2004-X, the Court found that an ex parte procedure before the trial judge was not sufficient to secure a fair trial where the undisclosed material related, or may have related, to an issue of fact which formed part of the prosecution case, which the trial judge, rather than the jury, had to determine and which might have been of decisive importance to the outcome of the applicants' trials.

However, if the Court's findings under the substantive test are inconclusive owing to a lack of information in the file, the lack of disclosure or contradictions in the parties" interpretations of events (see Bannikova, cited above, §§ 52 and 67; see also Edwards and Lewis v. the United Kingdom [GC], nos. 39647/98 and 40461/98, § 46, ECHR 2004-X, and V. v. Finland, no. 40412/98, § 80, 24 April 2007) or if the Court finds, on the basis of the substantive test, that an applicant was subjected to incitement, contrary to Article 6 § 1 of the Convention, it will be necessary for the Court to proceed, as a second step, with the procedural test of incitement.

In addition, Article 6 § 1 requires that the prosecution authorities should disclose to the defence all material evidence in their possession for or against the accused" (see Edwards and Lewis v. the United Kingdom [GC], nos. 39647/98 and 40461/98, ECHR 2004-X).

    KENNEDY c. ROYAUME-UNI

The interests of national security or the need to keep secret methods of investigation of crime must be weighed against the general right to adversarial proceedings (see, mutatis mutandis, Edwards and Lewis v. the United Kingdom [GC], nos. 39647/98 and 40461/98, § 46, ECHR 2004-X).
  • EGMR, 12.12.2013 - 19165/08

    DONOHOE v. IRELAND

Reviewing this Court's case-law (inter alia, Edwards and Lewis v. the United Kingdom [GC], nos. 39647/98 and 40461/98, ECHR 2004-X), the SCC found that, while it was unthinkable that information that would threaten lives or State security would be disclosed, the admission of PK's evidence without any inquiry into its basis would unfairly balance the trial in favour of the prosecution.

The case of Edwards and Lewis v. the United Kingdom ([GC], nos. 39647/98 and 40461/98, ECHR 2004-X) was distinguishable in a number of respects.

The relevant principles are, in my opinion, those that can be found in Rowe and Davis v. the United Kingdom [GC] (no. 28901/95, ECHR 2000-II) and Edwards and Lewis v. the United Kingdom [GC] (nos. 39647/98 and 40461/98, ECHR 2004-X).

    LAGUTIN AND OTHERS v. RUSSIA

Moreover, in cases where the lack of file disclosure or the conflicting nature of the parties" interpretation of events precludes the Court from establishing with a sufficient degree of certainty whether the applicant was subjected to police incitement, the procedural aspect becomes decisive (see Edwards and Lewis v. the United Kingdom [GC], nos. 39647/98 and 40461/98, § 46, ECHR 2004-X; V. v. Finland, no. 40412/98, § 72, 24 April 2007; and Constantin and Stoian v. Romania, nos.
