They made reference to Conka v. Belgium (no. 51564/99, ECHR 2002-I) and R.U. v. Greece (no. 2237/08, 7 June 2011).Nevertheless, in the context of Greece, the Court examined and found a violation of Article 5 § 1 under its second limb on the basis that the applicant's detention pending asylum proceedings could not have been undertaken for the purposes of deportation, given that national law did not allow for deportation pending a decision on asylum (see Ahmade v. Greece, no. 50520/09, §§ 142-144, 25 September 2012, and R.U. v. Greece, no. 2237/08, §§ 88-96, 7 June 2011).

Inhaftierung von unbestimmter Dauer des anschließenden Verfahrens treffe grundsätzlich auch Dublin-Rückkehrer, weil sie entweder in den Stand vor ihrer Ausreise - also in aller Regel als illegal Eingereiste - versetzt würden oder sogar wegen Flucht aus der Haft in Malta wegen illegaler Ausreise zur Strafhaft verurteilt würden (so z.B. im Fall Aden Ahmed gegen Malta, Entscheidung des EGMR vom 23. Juli 2013, a.a.O.).Die genannten NGOs berichteten weiterhin, dass es zwar entsprechende gesetzliche und administrative Regelungen gebe (vgl. die Darstellungen bei UNHCR vom 18. September 2013, sowie EGMR, Entscheidung vom 27. Juli 2010, Massoud gegen Malta, No. 24340/08 und vom 23. Juli 2013, Musa gegen Malta, No. 42337/12, beide HUDOC), diese den Inhaftierten jedoch keine effektiven und zügig durchgeführten Verfahren zur Überprüfung der Gesetzmäßigkeit und Angemessenheit der Haft(anordnungen) böten.

Ungeachtet der zum Teil schwierigen Verhältnisse (UNHCR von März 2013 in der im Oktober 2013 veröffentlichten Fassung: "Universal Periodic Review: Malta" und "Position on the detention of asylum-seekers in Malta" vom 18. September 2013, jeweils im Internet veröffentlicht; ausführlich VG Oldenburg, B. v. 17. Februar 2014 - 3 B 6974/13 - juris Rn 13 ff.) und der vom EGMR in Einzelfällen festgestellten Missstände (E. jeweils v. 23. Juli 2013 - Nr. 55352/12 - (Aden Ahmed ./. Malta) Rn 91 ff., 99 und - Nr. 42337/12 - (Suso Musa ./. Malta) jeweils zugänglich im Internet) liegt noch kein "systemisches Versagen" im Sinne der Rechtsprechung des EGMR (E. v. 2. Further relevant domestic law concerning the case is to be found in Suso Musa v. Malta (no. 42337/12, §§ 23-32, 23 July 2013).Despite the Court's findings in the cases of Suso Musa v. Malta (no. 42337/12, §§ 58-59) and Aden Ahmed (cited above, §§ 121-22) that, even assuming that such a remedy applied in the applicant's case, it was also not effective, the Government failed to explain why such a remedy was still available to the applicant despite such limitation and the circumstances as appeared at the time.
She relied on the case of Suso Musa v. Malta (no. 42337/12, 23 July 2013).
