In arriving at this conclusion, the Supreme Court had guidance from the present Court's established case-law under Article 10 of the Convention, according to which the limits of acceptable criticism are wider with regard to a politician than as regards a private individual (see, among others, the Lingens v. As to the applicant's complaint that the Supreme Court wrongly regarded the impugned statement as a value judgment and failed to give reasons in this respect, the Court recalls that it is not its function to deal with errors of fact or law allegedly committed by a national court unless and in so far as they may have infringed rights and freedoms protected by the Convention (see García Ruiz v. Austria (dec.), no. 42409/98, 21 February 2002)".In § 34 of the Pfeifer judgment, the Court found that the publication of a person's photograph fell within the scope of his or her private life even where the person concerned was a public figure (see Schüssel v. Austria (dec.), no. 42409/98, 21 February 2002, and Von Hannover, cited above, § 53).
