According to the Court's established case-law, States bear the burden of providing plausible explanations for injuries sustained in custody, failing which a clear issue arises under Article 3 of the Convention (see Selmouni v. France [GC], no. 25803/94, § 87, ECHR 1999-V, and Satık and Others v.Turkey, no. 31866/96, § 54, 10 October2000).The Court considers, as it has done in its previous judgments concerning similar operations in prisons in Turkey, that the prosecutor's statements were entirely inconsistent with the duties and functions of a public prosecutor at a time when an investigation was being conducted into the involvement of gendarmes in the incident (see, inter alia, Satık and Others v. Turkey, no. 31866/96, § 59, 10 October 2000).
