    "faktischer Iraner"; "real risk"; Abschiebung; Afghanistan; allgemeine Gewalt;

    An dieser Einschätzung hat der EGMR in jüngerer Zeit angesichts der ihm mittlerweile vorliegenden Informationen festgehalten (vgl. EGMR, Urteil vom 11.7.2017 - 46051/13 [S. M. A. v. Abschiebungsrelevante Lage in Afghanistan

    Auch der Europäische Gerichtshof für Menschenrechte geht in seinen jüngeren Entscheidungen weiterhin davon aus, dass die allgemeine Sicherheitslage in Afghanistan nicht in jedem Fall gegen Art. 3 EMRK verstößt (EGMR, Urteile vom 11. Juli 2017 46051/13 - Rdnr. 53, 54; vom 16. Mai 2017 - 15993/09 - Rdnr. 120, 121 und vom 12. Januar 2016 - 13442/08 - , NVwZ 2017, 293 Rdnr. 59).
  • VGH Bayern, 01.10.2020 - 13a B 20.31004

EGMR, U.v. 9.7.2020 - M.H./Finnland, Nr. 42255/18 - Rn. 48 ff.; U.v. 5.11.2019 - A. A./Schweiz, Nr. 32218/17 - NVwZ 2020, 538 Rn. 46; U.v. 11.7.2017 - S.M.A./Netherlands, Nr. 46051/13 - Rn. 53; U.v. 11.7.2017 - Soleimankheel and others/Netherlands, Nr. 41509/12 - Rn. 51; U.v. 11.7.2017 - G.R.S./Netherlands, Nr. 77691/11 - Rn. 39; U.v. 11.7.2017 - E.K./Netherlands, Nr. 72586/11 - Rn. 67; U.v. 11.7.2017 - E.P. and A.R./Netherlands, Nr. 63104/11 - Rn. 80; U.v. 16.5.2017 - M.M./Netherlands, Nr. 15993/09 - Rn. 120; U.v. 12.1.2016 - A.G.R./Niederlande, Nr. 13442/08 - NVwZ 2017, 293 - Rn. 59).

EGMR, U.v. 9.7.2020 - M.H./Finnland, Nr. 42255/18 - Rn. 48 ff.; U.v. 5.11.2019 - A. Auszug aus EGMR, 12.01.2016 - 46856/07
    To the extent that the first applicant complained that the refusal to grant him a residence permit and his consequential removal to Afghanistan were contrary to his rights under Article 8 and under Article 13 taken together with Article 8, the Court observes - given the strict separation under the provisions of the Netherlands Aliens Act 2000 (Vreemdelingenwet 2000) between an asylum application and a regular application for a residence permit for another purpose than asylum - that arguments based on Article 8 of the Convention cannot be entertained in asylum proceedings but should be raised in, for instance, proceedings on a regular application for a residence permit (see Mohammed Hassan v. the Netherlands and Italy and 9 other applications (dec.), no. 40524/10, § 13, 27 August 2013; J. v. the Netherlands (dec.), no. 33342/11, § 9, 18 October 2011; and Joesoebov v. the Netherlands (dec.), no 44719/06, § 27, 2 November 2010) or in proceedings concerning the imposition of an exclusion order (see Üner v. the Netherlands [GC], no. 46410/99, ECHR 2006-XII, and Arvelo Aponte v. the Netherlands, no. 28770/05, 3 November 2011).

A.W.Q. and D.H./The Netherlands - HUDOC Rn. 67; - 8161/07, S.D.M. and others/The Netherlands - HUDOC Rn. 74; - 39575/06, S.S./The Netherlands - HUDOC Rn. 62; - 46856/07, M.R.A. and others/The Netherlands - HUDOC Rn. 106; - 13442/08, A.G.R./The Netherlands - HUDOC Rn. 54).
