(décision du 6 juillet 1966, I Cz 62/66 OSP 1967/6/140).

KREUZ c. POLOGNE
Pologne (no 1), no 28249/95, § 60, CEDH 2001-VI ; Jedamski et Jedamska c. Pologne, no 73547/01, § 60, 26 juillet 2005 ; et Podbielski et PPU Polpure c. Pologne, no 39199/98, § 64, 26 juillet 2005). - EGMR, 26.07.2005 - 39199/98

FREDIN c.

STOENESCU v. ROMANIA
The Court's assessment 37. Unlike the large corpus of the Court's case-law dealing with the issue of allegedly excessive court fees, the present case does not deal with the matter of the applicant's access to a court, but rather with the domestic court's allegedly divergent interpretation of the law providing for the reimbursement of court fees; in that connection, the Court reiterates that the resolution of the issue of court costs may have implications for the fairness of the proceedings as a whole (see Stankiewicz v. Poland, no. 46917/99, § 60, ECHR 2006 VI).Having regard to its finding relating to Article 6 § 1 of the Convention (see paragraphs 44-45 above), the Court considers that it is not necessary to examine whether, in this case, there has been a violation of Article 1 of Protocol No. 1 (see, mutatis mutandis, Stankiewicz v. Poland, no. 46917/99, § 80, ECHR 2006-VI).

CEPEK c.
Autriche, no 30428/96, §§ 12-13, 6 février 2001 ; Stankiewicz c. Pologne, no 46917/99, § 60, CEDH 2006-VI ; Askon AD c. Bulgarie, no 9970/05, § 25, 16 octobre 2012).
- EGMR, 02.04.2015 - 13274/11
PAVLOVIC AND OTHERS v. CROATIA
Having regard to its finding relating to Article 6 § 1 of the Convention, the Court considers that it is not necessary to examine whether, in this case, there has been a violation of Article 1 of Protocol No. 1 (see, for example, Stankiewicz v. Poland, no. 46917/99, § 80, ECHR 2006-VI). - EGMR, 17.09.2013 - 22426/11
PRZEMYK v. POLAND
It is true that the Court's power to review compliance with domestic law is limited (see, mutatis mutandis, Fredin v. Sweden (no. 1), 18 February 1991, § 50, Series A no. 192, and Stankiewicz v. Poland, no. 46917/99, § 65, ECHR 2006-VII). - EGMR, 24.03.2022 - 48045/15
BENGHEZAL c. FRANCE
Russie (déc.), no 74778/14, § 34, 15 septembre 2020). - EGMR, 16.10.2012 - 34216/07
PIETKA v. POLAND
The resolution of the issue of court costs may have implications for the fairness of the proceedings as a whole (see Stankiewicz v. Poland, no. 46917/99, § 60, ECHR 2006-VI). - EGMR, 12.05.2022 - 49281/15
DRAGAN KOVACEVIC v. CROATIA
- In Stankiewicz v. Poland (no. 46917/99, ECHR 2006-VI), a violation was found because the prosecuting authorities enjoyed a privileged position with respect to the costs of civil proceedings. - EGMR, 11.10.2022 - 6016/16
COVENTRY v. THE UNITED KINGDOM
Unlike claimants, defendants generally have no choice regarding their initial involvement in litigation and thus the rationale for finding that an award of costs at the end of proceedings could act as a restriction on their right of access to court cannot apply to them with equal force (see, for example, Stankiewicz v. Poland, no. 46917/99, ECHR 2006 VI, in which the Court considered that while a prosecutor's privileged position with respect to the costs of civil proceedings was relevant to its overall assessment of the fairness of those proceedings, the defendants" right of access to court was not concerned). - EGMR, 23.10.2018 - 12055/17

PRZYDZIAL c. POLOGNE
Italie (no 37019/07, CEDH 1999-IX), S.N. c. Suède (no 34209/96, CEDH 2002-V), P.S. c. Allemagne (no 33900/96, 20 décembre 2001), Demski c. Pologne (no 22695/03, 4 novembre 2008), et W.S. c.
