LABITA c. ITALIE
Auszug aus EGMR, 28.07.2009 - 47709/99
It prohibits in absolute terms torture or inhuman or degrading treatment or punishment, irrespective of the circumstances and the victim's behaviour (see Labita v Italy [GC], no. 26772/95, 6.4.2000, § 119, ECHR 2000-IV). - EGMR, 19.04.2001 - 28524/95
PEERS v. GREECE
Auszug aus EGMR, 28.07.2009 - 47709/99
Furthermore, in considering whether a treatment is "degrading" within the meaning of Article 3, the Court will have regard to whether its object is to humiliate and debase the person concerned and whether, as far as the consequences are concerned, it adversely affected his or her personality in a manner incompatible with Article 3. Even the absence of such a purpose cannot conclusively rule out a finding of a violation of Article 3 (see Peers v. Greece, no. 28524/95, §§ 67-68, ECHR 2001-III; Valasinas v. Lithuania, no. 44558/98, § 101, ECHR 2001-VIII; and Iwanczuk v. Poland, no. 25196/94, § 52, 15 November 2001). - EGMR, 24.07.2001 - 44558/98
VALASINAS v. LITHUANIA

IWÁNCZUK v. POLAND
Moreover, it is sufficient if the victim is humiliated in his or her own eyes (see Tyrer v. the United Kingdom, judgment of 25 April 1978, Series A no. 26, p. 16, § 32, and Smith and Grady v. the United Kingdom, nos. 33985/96 ; 33986/96, § 120). - EGMR, 22.09.1993 - 15473/89
KLAAS c. ALLEMAGNE
Auszug aus EGMR, 28.07.2009 - 47709/99
The Court reiterates that recourse to physical force against a person which has not been made strictly necessary by his or her own conduct diminishes human dignity and is in principle an infringement of the right set forth in Article 3. Such a strict proportionality approach has been accepted by the Court also in respect of a situation where an individual is already under the full control of the police (see, among others, Klaas v. Germany, 22 September 1993, § 30, Series A no. 269; Rehbock v. Slovenia, no. 29462/95, §§ 68-78, ECHR 2000-XII; Milan c. France, no.7549/03, 24 January 2008, § 68). - EGMR, 06.09.1978 - 5029/71
Klass u.a. ./. Deutschland
Auszug aus EGMR, 28.07.2009 - 47709/99
The exceptions provided for in paragraph 2 of Article 8 of the Convention are to be interpreted narrowly (see Klass and Others v. Germany, 6 September 1978, § 42, Series A no. 28), and the need for them in a given case must be convincingly established. - EGMR, 25.03.1993 - 13134/87

The same holds true in so far as degrading treatment is concerned (see Costello-Roberts v. the United Kingdom, judgment of 25 March 1993, Series A no. 247-C, p. 59, § 30).

SLAVOV ET AUTRES c. BULGARIE
Pologne, no 47709/99, § 59, 28 juillet 2009).

GOLDER c. ROYAUME-UNI
Auszug aus EGMR, 21.10.2008 - 47709/99
Thus, the right to have third parties prosecuted or sentenced for a criminal offence cannot be asserted independently: it must be indissociable from the victim's exercise of a right to bring civil proceedings in domestic law, even if only to secure symbolic reparation or to protect a civil right such as the right to a "good reputation" (see Perez v. France [GC], no. 47287/99, § 70), Golder v. the United Kingdom, judgment of 21 February 1975, Series A no. 18, p. 13, § 27 and Tolstoy Miloslavsky v. the United Kingdom, judgment of 13 July 1995, Series A no. 316-B, p. 78, § 58). - EGMR, 13.07.1995 - 18139/91
