Royaume-Uni [GC], no 28957/95, § 77, CEDH 2002-VI). - EGMR, 28.01.2003 - 44647/98
PECK c. ROYAUME-UNI
Royaume-Uni, no 44647/98, § 57, CEDH 2003-I). - EKMR, 19.05.1976 - 6959/75
BRÜGGEMANN AND SCHEUTEN v. GERMANY
- EGMR, 02.08.1984 - 8691/79
MALONE v. THE UNITED KINGDOM
Royaume-Uni, arrêt du 2 août 1984, série A no 82, pp. 31-32, § 66).
- EGMR, 27.06.2017 - 931/13
SATAKUNNAN MARKKINAPÖRSSI OY AND SATAMEDIA OY v. FINLAND
Leaving aside the numerous cases in which the Court has held that the right to privacy in Article 8 covers the physical and psychological integrity of a person, private life has also been held to include activities of a professional or business nature (see Niemietz v. Germany, 16 December 1992, § 29, Series A no. 251 B) or the right to live privately, away from unwanted attention (see Smirnova v. Russia, nos. 46133/99 and 48183/99, § 95, ECHR 2003 IX (extracts)). - EGMR, 10.01.2012 - 42525/07
ANANYEV AND OTHERS v. RUSSIA
46133/99 and 48183/99, §§ 56 et seq., ECHR 2003-IX (extracts)). - EGMR, 10.11.2015 - 40454/07
Paris Match bekommt im Fall um Berichterstattung über Fürst Albert von Monaco …
This concept also includes the right to live privately, away from unwanted attention (see Smirnova v. Russia, nos. 46133/99 and 48183/99, § 95, ECHR 2003-IX (extracts)).
- EGMR, 22.05.2012 - 5826/03
IDALOV c. RUSSIE
France, 26 juin 1991, § 34, série A no 207, Smirnova c. Russie, nos 46133/99 et 48183/99, § 66, CEDH 2003-IX (extraits) ; et Mitev c. Bulgarie, no 40063/98, § 102, 22 décembre 2004).; Smirnova c. Russie, nos 46133/99 et 48183/99, §§ 56 et suiv., CEDH 2003-IX ; Tretyakov c. Ukraine, no 16698/05, § 59, 29 septembre 2011 ; et Vasilkoski et autres c. « l'ex-République yougoslave de Macédoine ", no 28169/08, § 64, 28 octobre 2010).
- EGMR, 27.07.2004 - 55480/00
SIDABRAS ET DZIAUTAS c. LITUANIE
- EGMR, 08.11.2005 - 6847/02
KHOUDOÏOROV c. RUSSIE
The arguments for and against release must not be "general and abstract" (see Smirnova v. Russia, nos. 46133/99 and 48183/99, § 63, ECHR 2003-IX). - EGMR, 28.11.2017 - 72508/13
MERABISHVILI c. GÉORGIE
Those risks must be duly substantiated, and the authorities" reasoning on those points cannot be abstract, general or stereotyped (see, among other authorities, Letellier v. France, 26 June 1991, § 51, Series A no. 207; Clooth v. Belgium, 12 December 1991, § 44, Series A no. 225; Smirnova v. Russia, nos. 46133/99 and 48183/99, § 63, ECHR 2003-IX (extracts); and Giorgi Nikolaishvili v. Georgia, no. 37048/04, §§ 73 and 76, 13 January 2009). - EGMR, 31.10.2013 - 20824/09
PERICA OREB v. CROATIA
As to the two periods of the applicant's pre-trial detention, namely between 4 August and 3 October 2008 and then between 28 October 2008 and 20 September 2010, the Court considers that, according to its case-law, where such periods can be examined before the Court having regard to the provisions of Article 35 § 1 of the Convention, a global assessment of the aggregate period is required (see, for example, Smirnova v. Russia, nos. 46133/99 and 48183/99, § 66, ECHR 2003-IX (extracts), and, mutatis mutandis, Idalov, cited above, § 130; and Dervishi, cited above, § 126).The arguments for and against release must not be "general and abstract" (see Smirnova v. Russia, nos. 46133/99 and 48183/99, § 63, ECHR 2003-IX).
- EGMR, 28.05.2009 - 26713/05
BIGAEVA c. GRECE
Allemagne, 16 décembre 1992, § 29, série A no 251-B). - EGMR, 28.11.2023 - 18269/18
KRACHUNOVA v. BULGARIA
Even if this latter point carries less significance in the instant case than in cases involving cross-border trafficking, the retention of the applicant's identify card still entailed a significant limitation on her freedom of movement - especially since identity documents could often be required for various routine tasks (see, mutatis mutandis, Smirnova v. Russia, nos. 46133/99 and 48183/99, § 97, ECHR 2003-IX (extracts), and Ahmadov v. Azerbaijan, no. 32538/10, § 46, 30 January 2020). - EGMR, 19.10.2010 - 20999/04

The Court acknowledges that everyone has the right to live privately, away from unwanted attention (see Smirnova v. Russia, nos. 46133/99 and 48183/99, § 95, ECHR 2003-IX (extracts)).
- EGMR, 10.11.2015 - 40454/07

- EGMR, 20.11.2018 - 14305/17

An important aspect of the right to respect for private life is the "right to live privately, away from unwanted attention" (see Smirnova v. Russia, nos. 46133/99 and 48183/99, § 95, ECHR 2003-IX (extracts); Sidabras and Dziautas v.

He believed this approach contradicted the Court's findings in Smirnova v. Russia (nos. 46133/99 and 48183/99, § 97, ECHR 2003-IX (extracts)) to the effect that "in their everyday life Russian citizens have to prove their identity unusually often, even when performing such mundane tasks as exchanging currency or buying train tickets. In contrast to Smirnova v. Russia (nos. 46133/99 and 48183/99, ECHR 2003-IX (extracts)), his passport had not been seized, so he had retained an identity document, and he had failed to show how the refusal to exchange his passport had affected his rights and freedoms.

GRADINGER c. AUTRICHE
Auszug aus EGMR, 03.10.2002 - 46133/99
As to Article 4 of Protocol No. 7, the Court recalls that the aim of this Convention provision is to prohibit the repetition of criminal proceedings that have been concluded by a final decision (see the Gradinger v. Austria judgment of 23 October 1995, Series A no. 328-C, p. 65, § 53). - EGMR, 10.12.1982 - 7604/76
FOTI ET AUTRES c. ITALIE
Auszug aus EGMR, 03.10.2002 - 46133/99
In the performance of its task, the Court is, notably, free to attribute to the facts of the case, as found to be established on the evidence before it, a characterisation in law different from that given by the applicant or, if need be, to view the facts in a different manner; furthermore, it has to take account not only of the original application but also of the additional documents intended to complete the latter by eliminating initial omissions or obscurities (see the Foti and Others v. Italy judgment of 10 December 1982, Series A no. 56, § 44). - EGMR, 06.12.1988 - 10588/83
BARBERÀ, MESSEGUÉ AND JABARDO v. SPAIN
Auszug aus EGMR, 03.10.2002 - 46133/99
The Court considers, first, that the presumption of innocence guaranteed by Article 6 § 2 of the Convention requires, inter alia, that when carrying out their duties, the members of a court should not start with the preconceived idea that the accused has committed the offence charged; the burden of proof is on the prosecution, and any doubt should benefit the accused (see, among other authorities, the Barberà, Messegué and Jabardo v. Spain judgment of 6 December 1988, Series A no. 146, p. 33, § 77).
