HAY contre le ROYAUME-UNI
Auszug aus EGMR, 12.10.2006 - 49438/99
The Court recalls at the outset that its competence to decide whether an applicant is a victim does not depend on an objection being raised by the respondent Government (see Hay v. the United Kingdom (dec.), no. 41894/98, ECHR 2000-XI; and Ekimdjiev v. Bulgaria (dec.), no. 47092/99, 3 March 2005; and also, mutatis mutandis, Blecic v. Croatia [GC], no. 59532/00, §§ 66-68, ECHR 2006-...).

Neumeister ./. Österreich
Auszug aus EGMR, 12.10.2006 - 49438/99
According to the Court's case-law, the amount of the bail must be set by reference to the detainees' assets and with due regard to the extent to which the prospect of its loss will be a sufficient deterrent to their absconding (see Neumeister v. Austria, judgment of 27 June 1968, Series A no. 8, p. 40 § 14). - EGMR, 08.03.2006 - 59532/00

SABEVA v. BULGARIA
A failure on their part to submit such information without a satisfactory explanation may therefore give rise to the drawing of inferences as to the well-foundedness of the applicant's allegations (see Timurtas v. Turkey, no. 23531/94, §§ 66 and 70, ECHR 2000-VI; Tanis and Others v. Turkey, no. 65899/01, § 163, ECHR 2005-VIII; Fedotov v. Russia, no. 5140/02, § 60, 25 October 2005; Khudoyorov v. Russia, no. 6847/02, § 113, ECHR 2005-X (extracts); Yordanov v. Bulgaria, no. 56856/00, § 83, 10 August 2006; Staykov v. Bulgaria, no. 49438/99, § 74, 12 October 2006; Kostadinov v. Bulgaria, no. 55712/00, § 48, 7 February 2008; and Gavazov, cited above, § 95).To reach its definitive findings, the Court did not need to rely on the CPT's report, which, as noted in the judgment, relates to other establishments (contrast Iovchev v. Bulgaria, no. 41211/98, § 130 in limine, 2 February 2006, and Todor Todorov v. Bulgaria, no. 50765/99, § 47, 5 April 2007) and makes no general observations about the conditions in psychiatric hospitals in Bulgaria (contrast I.I. v. POP BLAGA c. ROUMANIE
Roumanie, no 36293/02, § 45, 10 juin 2008, et mutatis mutandis, Staïkov c. Bulgarie, no 49438/99, § 90, 12 octobre 2006). - EGMR, 02.09.2014 - 17893/03
MARINESCU ET AUTRES c. ROUMANIE
Roumanie, no 36293/02, § 45, 10 juin 2008, et Staïkov c. Bulgarie, no 49438/99, § 90, 12 octobre 2006).

HOALGA ET AUTRES c. ROUMANIE
Bulgarie, no 44082/98, § 87, 9 juin 2005 ; Salayev c. Azerbaïdjan, no 40900/05, § 42, 9 novembre 2010, et Osypenko précité, § 49). - EGMR, 12.03.2013 - 31206/05
DJALTI c. BULGARIE
Bulgarie (déc.), no 36794/03, 18 mars 2008 ; Kirilov, précité, §§ 43-48 ; Shishmanov c. Bulgarie (no 2), no 18382/05, § 59, 10 février 2011 ; Iliev et autres c. Bulgarie, nos 4473/02 et 34138/04, § 56, 10 février 2011). - EGMR, 24.01.2012 - 22926/04
IORDAN PETROV c. BULGARIE
Slovenie, (no 29462/95, § 84, ECHR 2000-XII): durée de vingt-trois jours ; GB c. Suisse (no 27426/95, § 32, 30 novembre 2000) durée de trente-deux jours ; Mamedova c. Russie, (no 7064/05, § 96, 1er juin 2006) durée de trente-six jours ; Lebedev c. Russie, (précité, § 115): durée de vingt-six jours ; Mooren c. Allemagne (no 1364/03, § 73, 13 décembre 2007): durée de deux mois et vingt-deux jours ; Kostadinov c. Bulgarie (no 55712/00, § 88, 7 février 2008) et Fursenko c. Russie (no 26386/02, § 139, 24 avril 2008): durée de vingt-six jours dans les deux affaires. - EGMR, 12.02.2009 - 36205/06
GIOSAKIS c. GRECE (N° 2)

The relevant provisions of the Code of Criminal Procedure and the Bulgarian courts' practice at the relevant time are summarised in the Court's judgments in several similar cases (see, among others, the Nikolova v. Bulgaria [GC], no. 31195/96, §§ 25-36, ECHR 1999-II; Ilijkov v. Bulgaria, no. 33977/96, §§ 55-62, 26 July 2001; and Yankov v. Bulgaria, no. 39084/97, §§ 79-88, ECHR 2003-XII (Extracts)).
