Einstweiliger Rechtsschutz gegen Verkürzung des Genesenenstatus gerichtetes …
Eine Klage bzw. ein einstweiliger Rechtsschutz mit dem alleinigen Ziel der Nichtigkeitsfeststellung einer Norm könne nicht auf § 43 VwGO gestützt werden, da eine solche Klage auf kein Rechtsverhältnis abziele, sondern eine Umgehung des § 47 VwGO ermöglichen würde; dasselbe gelte für eine Klage auf Feststellung der Unanwendbarkeit einer Rechtsnorm wegen eines Verstoßes gegen höherrangiges Recht (BVerwG, U.v. 23.8.2007 - 7 C 13.06 - NVwZ 2007, 313.11). - VG Aachen, 16.12.2008 - 2 K 90/05 Liegen noch keine verlässlichen wissenschaftlichen Erkenntnisse über komplexe Gefährdungslagen - wie hier die schädlichen Wirkungen hochfrequenter elektromagnetischer Felder - vor, verlangt die staatliche Schutzpflicht auch von den Gerichten nicht, dass sie ungesicherten wissenschaftlichen Erkenntnissen etwa mit Hilfe des Prozessrechts durch Beweisaufnahme zur Durchsetzung verhelfen, vgl.
