NYLUND contre la FINLANDE
Auszug aus EGMR, 18.05.2006 - 55339/00
Hence, it is relevant for the assessment of the case that the applicant has shown, in the Court's opinion, demonstrable interest in and commitment to the child both before and after the birth (see no. 22920/93, dec. 6.4.1994, D.R.77-A, p. 115; Nylund v. Finland (dec.), no. 27110/95, ECHR 1999-VI).However, in Nylund v. Finland (dec.), no. 27110/95, ECHR 1999-VI, and later in Yousef v. the Netherlands, no. 33711/96, ECHR 2002-VIII, the Court took a different approach and found that some limitations on paternity claims might be compatible with the Convention.

KROON AND OTHERS v. THE NETHERLANDS
Auszug aus EGMR, 18.05.2006 - 55339/00
In both contexts regard must be had to the fair balance that has to be struck between the competing interests of the individual and of the community as a whole; and in both contexts the State enjoys a certain margin of appreciation (Keegan v. Ireland, judgment of 26 May 1994, Series A no. 290, p. 19, § 49; Kroon and Others v. the Netherlands, judgment of 27 October 1994, Series A no. 297-C, p. 56, § 31). - EGMR, 23.09.1994 - 19823/92
HOKKANEN v. FINLAND
Auszug aus EGMR, 18.05.2006 - 55339/00
The Court reiterates that its task is not to substitute itself for the competent domestic authorities in regulating paternity disputes at the national level, but rather to review under the Convention the decisions that those authorities have taken in the exercise of their power of appreciation (see Mikulic, cited above, § 59; Hokkanen v. Finland, judgment of 23 September 1994, Series A no. 299-A, p. 20, § 55). - EGMR, 26.05.1994 - 16969/90

Anayo ./. Deutschland
Finnland (Entsch.), Individualbeschwerde Nr. 27110/95, ECHR 1999-VI; N. ./. Deutschland (Entsch.), Individualbeschwerde Nr. 46165/99, 19. Juni 2003;… Lebbink, a.a.O., Rdnr. 36; und H. ./. H.-G. H. gegen Deutschland
Polen , Individualbeschwerde Nr. 55339/00, Rdnr. 64, 18. Mai 2006;… G. ./. Deutschland , Individualbeschwerde Nr. 74969/01, Rdnr. 10, 35, 26. A.L. v. POLAND
They further maintained that contrary to Paulík v. Slovakia (no. 10699/05, ECHR 2006-XI (extracts) and Rózanski v. Poland (no. 55339/00, 18 May 2006), after the time-limit for his own claim had expired, the applicant had at his disposal a legal measure to determine his claim, namely Article 86 of the Family and Custody Code, which allowed the prosecutor to bring an action for annulment of the declaration recognising the child.

VAGDALT v. HUNGARY
Having examined the manner in which all those elements taken together affected the applicant's situation, the Court concludes that, even having regard to the margin of appreciation left to the State, it failed to secure to the applicant the respect for his family life to which he is entitled under the Convention (see, mutatis mutandis, Ró?¼a?„ski v. Poland, no. 55339/00, § 79, 18 May 2006). - EGMR, 19.07.2016 - 25057/11
CALIN ET AUTRES c. ROUMANIE
Grèce, no 58809/09, § 43, 3 avril 2014, Röman, précité, § 46, et Rózanski c. Pologne, no 55339/00, § 62, 18 mai 2006). - EGMR, 20.12.2007 - 23890/02
PHINIKARIDOU c. CHYPRE
Pologne, no 55339/00, § 62, 18 mai 2006 ; Mikulic, précité, § 59, et Hokkanen c. Finlande, 23 septembre 1994, § 55, série A no 299-A).

KOYCHEV c. BULGARIE
Pologne, no 55339/00, §§ 60-61, 18 mai 2006, et Mizzi c. Malte, no 26111/02, §§ 105-106, CEDH 2006-I (extraits)). - EGMR, 19.10.2021 - 69997/17
LAVANCHY c. SUISSE
Pologne, no 55339/00, § 62, 18 mai 2006, et Phinikaridou, précité, § 48). - EGMR, 06.02.2018 - 15819/16
PATRIKU c.
Irlande, 26 mai 1994, § 49, série A no 290, et Rózanski c. Pologne, no 55339/00, § 61, 18 mai 2006).

NYLUND contre la FINLANDE
Auszug aus EGMR, 10.03.2005 - 55339/00
Relevant factors in this regard include the nature of the relationship between the natural parents and the demonstrable interest in and commitment by the natural father to the child both before and after the birth (see no. 22920/93, dec. 6.4.1994, D.R.77-A, p. 115; Nylund v. Fall E. gegen DEUTSCHLAND
Auszug aus EGMR, 10.03.2005 - 55339/00
Thus there exists between the child and the parents a relationship amounting to family life (see Keegan v. Ireland, loc. cit., § 44, Elsholz v. Germany [GC], no. 25735/94, ECHR 2000-VIII, § 43, and Yousef v. the Netherlands, no. 33711/96, § 51, ECHR 2002-VIII). - EGMR, 26.05.1994 - 16969/90
KEEGAN v. IRELAND
Auszug aus EGMR, 10.03.2005 - 55339/00
The Court recalls that the notion of "family life" in Article 8 is not confined solely to marriage-based relationships and may encompass other de facto "family" ties where the parties are living together outside marriage (see the Keegan v. Ireland judgment of 26 May 1994, Series A no. 290, pp. 17-18, § 44 and the Kroon and Others v. the Netherlands judgment of 20 September 1994, Series A no. 297-C, pp. 55-56, § 30). - EGMR, 27.10.1994 - 18535/91
