JANKOVIC c. CROATIE
Auszug aus EGMR, 18.02.2009 - 55707/00
Nor does it guarantee, as such, any right to a pension of a particular amount (see, for example, Kjartan Ásmundsson v. Iceland, no. 60669/00, § 39, ECHR 2004-IX; Domalewski v. Poland (dec.), no. 34610/97, ECHR 1999-V; and Jankovic v. Croatia (dec.), no. 43440/98, ECHR 2000-X).Certainly, other alleged property rights cases which have arisen in the context of the reunification of Germany and the dissolution of Yugoslavia have taken the particular context into consideration when applying the Convention (see, for example, Jankovic v. Croatia (dec.), no. 43440/98, ECHR 2000-X; Hadzic v. Croatia (dec.) no. 48788/99, 13 September 2001; and Schwengel v. Germany (dec.), no. 52442/99, 2 March 2000).

KOUA POIRREZ c. FRANCE
Auszug aus EGMR, 18.02.2009 - 55707/00
The Government acknowledged that in Koua Poirrez v. France (no. 40892/98, ECHR 2003-X) the Court had refused to make a distinction between contributory and non-contributory welfare benefits, finding that Article 1 of Protocol No. 1 was also applicable to the latter category and, subsequently, that there had been a violation of Article 14 of the Convention.65731/01 and 65900/01, §§ 74 and 76, ECHR 2005-X), the admissibility decision in which has served as the guiding case-law to the majority, and Koua Poirrez v. France (no. 40892/98, ECHR 2003-X), because the interacting rules of international law in this case are different.

65731/01 and 65900/01, ECHR 2005-X) - that fact was immaterial.65731/01 and 65900/01, §§ 74 and 76, ECHR 2005-X), the admissibility decision in which has served as the guiding case-law to the majority, and Koua Poirrez v. A.N.R.P.und 275 andere gegen Deutschland
Auszug aus EGMR, 18.02.2009 - 55707/00
Moreover, it was Latvia that was a victim of the Soviet aggression and the Court has normally drawn a distinction between States or regimes which have caused suffering and States which of their own good will, free from any obligation, have decided to compensate, at least partly, for the damage caused (see, mutatis mutandis, Associazione Nazionale Reduci dalla Prigionia dall'Internamento e dalla Guerra di Liberazione and Others v. Germany (dec.), no. 45563/04, 4 September 2007, in which Germany was not attributed responsibility for the damage caused by the German Reich, and Wos v. Poland (dec.), no. 22860/02, ECHR 2005-IV, in which partial compensation for slave labour during the Second World War did not create an additional obligation on Poland). - EGMR, 10.04.2001 - 52449/99
KUNA v. GERMANY
Auszug aus EGMR, 18.02.2009 - 55707/00
However, in such cases, for all the above reasons, the Court has to accept that the particular context is an important justification for the necessary distinctions (see Kuna v. Germany (dec.), no. 52449/99, ECHR 2001-V). - EGMR, 02.03.2000 - 52442/99
SCHWENGEL contre l'ALLEMAGNE
Auszug aus EGMR, 18.02.2009 - 55707/00
Certainly, other alleged property rights cases which have arisen in the context of the reunification of Germany and the dissolution of Yugoslavia have taken the particular context into consideration when applying the Convention (see, for example, Jankovic v. Croatia (dec.), no. 43440/98, ECHR 2000-X; Hadzic v. Croatia (dec.) no. 48788/99, 13 September 2001; and Schwengel v. Germany (dec.), no. 52442/99, 2 March 2000). - EGMR, 09.03.2006 - 66820/01
SVIPSTA c. LETTONIE
Auszug aus EGMR, 18.02.2009 - 55707/00
Furthermore, costs and expenses are only recoverable in so far as they relate to the violation found (see, among many other authorities, Iatridis v. Greece (just satisfaction) [GC], no. 31107/96, § 54, ECHR 2000-XI; Beyeler v. Italy (just satisfaction) [GC], no. 33202/96, § 27, 28 May 2002; and Svipsta v. Latvia, no. 66820/01, § 170, ECHR 2006-III). - EGMR, 04.05.2006 - 62393/00
KADIKIS c. LETTONIE (N° 2)
Auszug aus EGMR, 18.02.2009 - 55707/00
Furthermore, the indispensable condition for making an award in respect of pecuniary damage is the existence of a causal link between the damage alleged and the violation found (see Nikolova v. Bulgaria [GC], no. 31195/96, § 73, ECHR 1999-II), and this is also true of non-pecuniary damage (see KadiÄ is v. Latvia (no. 2), no. 62393/00, § 67, 4 May 2006). - EGMR, 31.07.2007 - 65022/01
ZAICEVS v. LATVIA
Auszug aus EGMR, 18.02.2009 - 55707/00
In those circumstances, ruling on an equitable basis as required by Article 41, it decides to award her EUR 1, 500 in respect of all costs and expenses, together with any taxes that may be chargeable to her (see Svipsta, loc.cit., and Zaicevs v. Latvia, no. 65022/01, § 64, ECHR 2007-...). - EGMR, 13.07.2000 - 39221/98
SCOZZARI ET GIUNTA c. ITALIE
Auszug aus EGMR, 18.02.2009 - 55707/00
The Court reiterates at the outset that the respondent State remains free to choose the means by which it will discharge its legal obligation under Article 46 of the Convention, provided that such means are compatible with the conclusions set out in the Court's judgment (see Scozzari and Giunta v. SEJDIC ET FINCI c. BOSNIE-HERZÉGOVINE
"No objective and reasonable justification" means that the distinction in issue does not pursue a "legitimate aim" or that there is not a "reasonable relationship of proportionality between the means employed and the aim sought to be realised" (see, among many authorities, Andrejeva v. Latvia [GC], no. 55707/00, § 81, 18 February 2009). - EGMR, 09.06.2022 - 49270/11
SAVICKIS AND OTHERS v. LATVIA
Lettonie [GC], no 55707/00, § 74, CEDH 2009-... ; et, plus récemment, Carson et autres c. Royaume-Uni [GC], no 42184/05, § 63, CEDH 2010-...).
- EGMR, 07.02.2013 - 16574/08
FABRIS c. FRANCE
Likewise, the concept of "possessions" may extend to a particular benefit of which the persons concerned have been deprived on the basis of a discriminatory condition of entitlement (see Andrejeva v. Latvia [GC], no. 55707/00, § 79, ECHR 2009). - EGMR, 18.09.2009 - 16064/90
VARNAVA ET AUTRES c. TURQUIE
As regards the applicants' views concerning the provision of an effective investigation, the Court reiterates the general principle that the respondent State remains free to choose the means by which it will discharge its legal obligation under Article 46 of the Convention, provided that such means are compatible with the conclusions set out in the Court's judgment (see Scozzari and Giunta v. Italy [GC], nos. 39221/98 and 41963/98, § 249, ECHR 2000-VIII; and Andrejeva v. Latvia [GC], no. 55707/00, § 110, ECHR 2009-...). - EGMR, 31.05.2011 - 24120/06

CARSON ET AUTRES c. ROYAUME-UNI
The Court observes at the outset that, as with all complaints of alleged discrimination in a welfare or pensions system, it is concerned with the compatibility with Article 14 of the system, not with the individual facts or circumstances of the particular applicants or of others who are or might be affected by the legislation (see, for example, Stec and Others, cited above, §§ 50-67; Burden, cited above, §§ 58-66; Andrejeva v. RAFFINERIES GRECQUES STRAN ET STRATIS ANDREADIS c.
- EGMR, 21.01.1999 - 30544/96

Espagne [GC], no 30544/96, §§ 28-29, CEDH 1999-I).
