    FRYDLENDER c. FRANCE

    Auszug aus EGMR, 10.05.2007 - 56026/00
The Court reiterates that the reasonableness of the length of proceedings must be assessed in the light of the circumstances of the case and with reference to the following criteria: the complexity of the case, the conduct of the applicant and the relevant authorities and what was at stake for the applicant in the dispute (see, among many other authorities, Frydlender v. France [GC], no. 30979/96, § 43, ECHR 2000-VII; Zynger v. Poland, no. 66096/01, § 45, 13 July 2004).

    Auszug aus EGMR, 10.05.2007 - 56026/00
[1] For a detailed presentation of the relevant domestic law concerning the available remedies against excessive length of proceedings, see Ratajczyk v. Poland (dec.), no. 11215/02, ECHR 2005; Barszcz v. Poland, no. 71152/01, 30 May 2006, §§ 26-35.

    OREL v. SLOVAKIA

    Auszug aus EGMR, 10.05.2007 - 56026/00
Thus, in the circumstances of this case, it is questionable whether the first applicant's complaint, had she presented it in the way prescribed by the 2004 Act would have been any more successful (compare Orel v. Slovakia, no. 67035/01, § 77-78, 9 January 2007).

    WOJCIK AND OTHERS v. POLAND

The relevant domestic law and practice concerning remedies for the excessive length of judicial proceedings, in particular the applicable provisions of the 2004 Act, are stated in the Court's decisions in cases of Charzynski v. Poland no. 15212/03 (dec.), §§ 12-23, ECHR 2005-V and Ratajczyk v. Poland no. 11215/02 (dec.), ECHR 2005-VIII and judgments in the cases of Krasuski v. Poland, no. 61444/00, §§ 34-46, ECHR 2005-V and Wende and Kukówka v. Poland, no. 56026/00, § 38-42, 10 May 2007.

The Court considered that when the relevant law provided individuals with a possibility of lodging a complaint without being represented by a lawyer, the domestic court should advise applicants on how to remedy the formal deficiencies of their complaints (see Wende and Kukówka v. Poland, no. 56026/00, § 52-56, 10 May 2007; Wawrzynowicz v. Poland, no. 73192/01, § 52-56, 17 July 2007).

    SULWINSKA v. POLAND

As to the circumstances of the instant case, the Court notes that it has specified in a number of cases the nature and extent of the obligations which arise for the respondent State under Articles 6 and 13 of the Convention as regards the guarantees of the right to a trial within a reasonable time (see, among many others, Kusmierek v. Poland, no. 10675/02, judgment of 21 September 2004; Zynger v. Poland, no. 66096/01, judgment of 13 July 2004) and the requirement of an effective remedy capable of providing appropriate redress for the damage resulting from the breach of this right (see Kudla v. Poland [GC], no. 30210/96, ECHR 2000-XI; Krasuski v. Poland, no. 61444/00, ECHR 2005-... (extracts); Charzynski v. Poland (dec.), no. 15212/03, ECHR 2005-...; Majewski v.
