NILSEN AND JOHNSEN v. NORWAY
Auszug aus EGMR, 02.11.2004 - 61333/00
The Court reiterates that, in order for costs and expenses to be included in an award under Article 41, it must be established that they were actually and necessarily incurred in order to prevent or obtain redress for the matter found to constitute a violation of the Convention and were reasonable as to quantum (see, among many other authorities, Nilsen and Johnsen v. Norway [GC], no. 23118/93, § 62, ECHR 1999-VIII).

LIZANETS v. UKRAINE
In assessing the domestic judicial practices against their compatibility with the principle of legal certainty the Court primarily focused on the extraordinary review proceedings susceptible to undermine the finality of court judgments (cf., Popov v. Moldova (no. 2), no. 19960/04, § 52, 6 December 2005, Tregubenko v. Ukraine, no. 61333/00, § 36, 2 November 2004, Ryabykh v. Russia, no. 52854/99, § 57, ECHR 2003-IX and Svetlana Naumenko v. Ukraine, no. 41984/98, § 92, 9 November 2004). - EGMR, 17.09.2009 - 27865/02
BOCVARSKA v.
It is the established jurisprudence of this Court that the quashing of a final and binding judgment that conferred a "possession" on the applicant constitutes an interference with the applicant's right to that property (see Tregubenko v. Ukraine, no. 61333/00, § 51, 2 November 2004, and Brumarescu v. Romania [GC], no. 28342/95, § 74, ECHR 1999-VII).

KONDRASHOVA v. RUSSIA
In the case of Tregubenko v. Ukraine (no. 61333/00, 2 November 2004) the Court found a violation of Article 1 of Protocol No. 1 to the Convention in that the quashing of a final judgment of pecuniary nature in the applicant's favour constituted a disproportionate interference with his right to the peaceful enjoyment of his possessions. - EGMR, 08.11.2005 - 63158/00
TIMOTIYEVICH v. UKRAINE
The Court has previously found violations of Article 6 § 1 of the Convention in similar cases against Ukraine, holding that such measures are incompatible with the principles of the rule of law and legal certainty enshrined in that provision (see Sovtransavto Holding v. Ukraine, no. 48553/99, § 77, ECHR 2002-VII; Tregubenko v. Ukraine, no. 61333/00, §§ 44-45, 2 November 2004; Svetlana Naumenko v. Ukraine, no. 41984/98, § 92, 9 November 2004). - EGMR, 18.01.2007 - 55531/00
SITKOV v. RUSSIA
In the case Tregubenko v. Ukraine (no. 61333/00, § 46 et seq., 2 November 2004) the Court found a violation of Article 1 of Protocol no. 1 to the Convention in that the quashing of a final judgment of pecuniary nature in the applicant's favour constituted a disproportionate interference with his right to the peaceful enjoyment of his possessions.
