HERBECQ ET l'ASSOCIATION " LIGUE DES DROITS DE l'HOMME" contre la BELGIQUE

    Auszug aus EGMR, 17.07.2003 - 63737/00
The monitoring of the actions of an individual in a public place by the use of photographic equipment which does not record the visual data does not, as such, give rise to an interference with the individual's private life (see, for example, Herbecq and Another v. Belgium, applications nos. 32200/96 and 32201/96, Commission decision of 14 January 1998, DR 92-A, p. 92).

Urteil Kruslin ./. Frankreich vom 24. April 1990, Serie A Band 176-A, S. 20, Nr. 27; Urteil Huvig ./. Frankreich vom 24. Ungarns Anti-Terror-Gesetz ist menschenrechtswidrig

The expression "in accordance with the law" in Article 8 § 2 requires, first, that the impugned measure should have some basis in domestic law; it also refers to the quality of the law in question, requiring that it should be compatible with the rule of law and accessible to the person concerned, who must, moreover, be able to foresee its consequences for him (see, among other authorities, Kruslin v. France, 24 April 1990, § 27, Series A no. 176-A; Huvig, cited above, § 26; Lambert v. France, 24 August 1998, § 23, Reports 1998-V; Perry v. the United Kingdom, no. 63737/00, § 45, ECHR 2003-IX (extracts); Dumitru Popescu v. Romania (no. 2), no. 71525/01, § 61, 26 April 2007; Association for European Integration, cited above, § 71; and Liberty, cited above, § 59).

    SHIMOVOLOS v. RUSSIA

There is, therefore, a zone of interaction of a person with others, even in a public context, which may fall within the scope of "private life" (see Perry v. the United Kingdom, no. 63737/00, § 36, ECHR 2003-IX (extracts); Peck v. the United Kingdom, no. 44647/98, § 57, ECHR 2003-I, and P.G. and J.H. v. the United Kingdom, no. 44787/98, § 56, ECHR 2001-IX).
  • EGMR, 04.07.2023 - 11519/20

    GLUKHIN v. RUSSIA

It has also found that the following instances of collection of data in a public place constituted an interference with the persons' private lives: the recording of a questioning in a public area of a police station (see P.G. and J.H. v. the United Kingdom, no. 44787/98, §§ 56-60, ECHR 2001-IX); recording by CCTV cameras in a public place and the subsequent disclosure of the videofootage to the media (see Peck v. the United Kingdom, no. 44647/98, §§ 57-63, ECHR 2003-I); recording of videofootage at a police station and its subsequent use in criminal proceedings (see Perry v. the United Kingdom, no. 63737/00, §§ 36-43, ECHR 2003-IX (extracts); the collection, through a GPS device attached to a person's car, and storage of data concerning that person's whereabouts and movements in the public sphere (see Uzun.
  • EGMR, 12.12.2013 - 20383/04

    KHMEL v. RUSSIA

Noting that the footage had not been obtained voluntarily or in circumstances where it could be reasonably anticipated that it would be made, the Court considered that the recording and use of the video disclosed an interference with the applicant's right to respect for private life (see Perry v. the United Kingdom, no. 63737/00, §§ 39-43, ECHR 2003-IX).
  • EGMR, 08.03.2011 - 12739/05

    GORANOVA-KARAENEVA v. BULGARIA

The district court dealing with the criminal case against the applicant specifically considered that question and found that the covert operation against the applicant had not been unlawful (see paragraph 17 above, and contrast Perry v. the United Kingdom, no. 63737/00, § 47, ECHR 2003-IX (extracts)).

    P.G. AND J.H. v. THE UNITED KINGDOM

    Auszug aus EGMR, 26.09.2002 - 63737/00
It would observe that the use at trial of material obtained without a proper legal basis or through unlawful means will not generally offend the standard of fairness imposed by Article 6 § 1 where proper procedural safeguards are in place and the nature and source of the material is not tainted, for example, by any oppression, coercion or entrapment which would render reliance on it unfair in the determination of a criminal charge (see the above-mentioned Schenk and Khan v. the United Kingdom judgments; also P.G. and J.H. v. the United Kingdom, no. 44787/98, ECHR 2001-IX).

    SCHENK c. SUISSE

    Auszug aus EGMR, 26.09.2002 - 63737/00
While Article 6 guarantees the right to a fair hearing, it does not lay down any rules on the admissibility of evidence as such, which is therefore primarily a matter for regulation under national law (see the Schenk v. Switzerland judgment of 12 July 1988, Series A no. 140, §§ 45 and 46, and, for a more recent example in a different context, the Teixeira de Castro v. Portugal judgment of 9 June 1998, Reports 1998-IV, § 34).
