Turquie, no 31889/96, § 105, 14 février 2002). - EGMR, 28.07.1999 - 25803/94

France, arrêt du 27 août 1992, série A no 241-A, pp. 40-41, §§ 108-111, Ribitsch c. Autriche, arrêt du 4 décembre 1995, série A no 336, pp. 25-26, § 34, Selmouni c. Turquie, no 20764/92, § 131, CEDH 2000-V). - EGMR, 24.03.2005 - 21894/93
AKKUM AND OTHERS v. TURKEY
Turquie, no 21894/93, § 209, CEDH 2005-II). - EGMR, 13.06.2000 - 23531/94
TIMURTAS c. TURQUIE
Turquie, no 27244/95, § 128, 9 mai 2003). - EGMR, 27.06.2000 - 21986/93

Royaume-Uni, arrêt du 18 janvier 1978, série A no 25, pp. 64-65, § 161, et Salman c. Turquie [GC], no 21986/93, § 100, CEDH 2000-VII). - EGMR, 04.12.1995 - 18896/91

Massaker von Katyn
It can also result from the failure of the authorities to respond to the quest for information by the relatives or from the obstacles placed in their way, leaving them to bear the brunt of the efforts to uncover any facts, where this attitude may be regarded as disclosing a flagrant, continuous and callous disregard of an obligation to account for the fate of the missing person (see, in particular, Açıs v. Turkey, no. 7050/05, §§ 36 and 51-54, 1 February 2011; Varnava and Others, cited above, § 200; OsmanoÄŸlu v. Turkey, no. 48804/99, § 96, 24 January 2008; Luluyev and Others v. Russia, no. 69480/01, § 114, ECHR 2006-XIII (extracts); Bazorkina v. Russia, no. 69481/01, § 139, 27 July 2006; Gongadze v. Ukraine, no. 34056/02, § 184, ECHR 2005-XI; Tanis and Others v. Turkey, no. 65899/01, § 219, ECHR 2005-VIII; Orhan v. Turkey, no. 25656/94, § 358, 18 June 2002; and Çakıcı v. Turkey [GC], no. 23657/94, § 98, ECHR 1999-IV). - EGMR, 18.09.2009 - 16064/90
VARNAVA ET AUTRES c. TURQUIE
The burden of proof may then be regarded as resting on the authorities to provide a satisfactory and convincing explanation (Salman v. Turkey [GC], no. 21896/93, § 100, ECHR 2000-VII; Akdeniz and Others v. Turkey, no. 23954/94, §§ 85-89, 31 May 2000); see also cases short of custody, where it is possible to establish that an individual entered a place under those authorities' control and has not been seen since, in which circumstances, the onus is on the Government to provide a plausible explanation of what happened on the premises and to show that the person concerned was not detained by the authorities, but left the premises without subsequently being deprived of his or her liberty (e.g. Tanis and Others v. Turkey, no. 65899/01, § 160, ECHR 2005-VIII; Yusupova and Zaurbekov v. Russia, no. 22057/02, §§ 50-55, 9 October 2008). - EGMR, 09.02.2021 - 26638/07
KONUK ET AUTRES c. TURQUIE
Turquie, no 65899/01, CEDH 2005-VIII.

ENZILE ÖZDEMIR v. TURKEY
The relevant domestic law and practice in force at the material time are outlined in the following judgments: Tanıs and Others v. Turkey, no. 65899/01, §§ 154-157, ECHR 2005-VIII, and Tepe v. Turkey, no. 27244/95, §§ 115-122, 9 May 2003.The Court's case-law has established that there must be a clear causal connection between the damage claimed by the applicant and the violation of the Convention and that the award may, in an appropriate case, include compensation for loss of earnings (see, among other authorities, Tanıs and Others v. Turkey, no. 65899/01, § 231, ECHR 2005-...).
- EGMR, 09.11.2006 - 7615/02
IMAKAÏEVA c. RUSSIE
When, as in the instant case, the respondent Government have exclusive access to information able to corroborate or refute the applicants' allegations, any lack of cooperation by the Government without a satisfactory explanation may give rise to the drawing of inferences as to the wellfoundedness of the applicants' allegations (see Tani and Others v. Turkey, no. 65899/01, § 160, ECHR 2005-...). - EGMR, 12.11.2013 - 23502/06
Bomben auf kurdische Dörfer: Türkei muss Schmerzensgeld zahlen
In support of their submissions the applicants referred to a number of judgments in which the Court found violations of various Convention provisions on account of enforced disappearances, intentional destruction of villages and killings perpetrated by agents of the State in the Sırnak area, as well as on account of the failures to carry out effective investigations into those incidents (see Ertak v. Turkey, no. 20764/92, ECHR 2000-V; Ahmet Özkan and Others, cited above; Timurtas v. Turkey, no. 23531/94, ECHR 2000-VI; Tas v. Turkey, no. 24396/94, 14 November 2000; Dündar v. Turkey, no. 26972/95, 20 September 2005; Tanıs and Others v. Turkey, no. 65899/01, ECHR 2005-VIII). - EGMR, 18.12.2012 - 2944/06
ASLAKHANOVA AND OTHERS v. RUSSIA
In this context, the conduct of the parties when evidence is being obtained has to be taken into account (see Tanis and Others v. Turkey, no. 65899/01, § 160, ECHR 2005-VIII). - EGMR, 16.04.2012 - 55508/07
JANOWIEC AND OTHERS v. RUSSIA
The Court emphasises that the finding of such a violation is not limited to cases where the respondent State has been held responsible for the disappearance but can arise where the failure of the authorities to respond to the quest for information by the relatives or the obstacles placed in their way, leaving them to bear the brunt of the efforts to uncover any facts, may be regarded as disclosing a flagrant, continuous and callous disregard of an obligation to account for the fate of the missing person (see, amongst many authorities, Varnava and Others, cited above, § 200; OsmanoÄ?lu v. Turkey, no. 48804/99, § 96, 24 January 2008; Bazorkina v. Russia, no. 69481/01, § 139, 27 July 2006; Imakayeva, § 164, and Gongadze, § 184, both cited above; Tanis and Others v. Turkey, no. 65899/01, § 219, ECHR 2005-VIII; Orhan v. Turkey, no. 25656/94, § 358, 18 June 2002, and Çakıcı v. Turkey [GC], no. 23657/94, § 98, ECHR 1999-IV). - EGMR, 15.04.2014 - 7524/06
CÜLAZ ET AUTRES c. TURQUIE
- EGMR, 23.02.2012 - 29226/03
CREANGA c. ROUMANIE
In such circumstances, the onus is on the Government to provide a plausible and satisfactory explanation as to what happened on the premises and to show that the person concerned was not detained by the authorities, but left the premises without subsequently being deprived of his or her liberty (see Tanıs and Others v. Turkey, no. 65899/01, § 160, ECHR 2005-VIII, and Yusupova and Zaurbekov v. Russia, no. 22057/02, § 52, 9 October 2008). - EGMR, 10.12.2013 - 13660/05
