  • EGMR, 21.02.1975 - 4451/70

    GOLDER c. ROYAUME-UNI

    Auszug aus EGMR, 18.10.2005 - 6778/05
As to the question of access to court, the Court recalls that the procedural guarantees laid down in Article 6 secure to everyone the right to have any claim relating to his civil rights and obligations brought before a court or tribunal; in this way it embodies the "right to a court", of which the right of access, that is the right to institute proceedings before courts in civil matters, constitutes one aspect (see Golder v. the United Kingdom, judgment of 21 February 1975, Series A no. 18, pp. 13-18, §§ 28-36).
  • EGMR, 06.11.1980 - 7654/76

    VAN OOSTERWIJCK c. BELGIQUE

    Auszug aus EGMR, 18.10.2005 - 6778/05
It would add that the existence of mere doubts as to the prospects of success of a particular domestic remedy, which is not obviously futile, is not a valid reason for failing to exhaust it (see the Van Oosterwijck v. Belgium judgment of 6 November 1980, Series A no. 40, p. 18, § 37, and A.B. v. the Netherlands, no. 37328/97, 29 January 2002, § 72).
  • EGMR, 28.06.2011 - 8319/07

SUFI AND ELMI v. THE UNITED KINGDOM

The Court has consistently held that mere doubts as to the prospects of success of national remedies do not absolve an applicant from the obligation to exhaust those remedies (see, inter alia, Pellegrini v. Italy (dec.), no. 77363/01, 26 May 2005; MPP Golub v. Ukraine (dec.), no. 6778/05, 18 October 2005; and Milosevic v. the Netherlands (dec.), no. 77631/01, 19 March 2002).
  • EGMR, 15.03.2022 - 21881/20

COMMUNAUTÉ GENEVOISE D'ACTION SYNDICALE (CGAS) c. SUISSE

Pays-Bas (déc.), no 77631/01, 19 mars 2002, Pellegriti c. Italie (déc.), no 77363/01, 26 mai 2005, MPP Golub c. Ukraine (déc.), no 6778/05, 18 octobre 2005, Vuckovic et autres c. Serbie (exception préliminaire) [GC], nos 17153/11 et 29 autres, §§ 74 et 84, 25 mars 2014).
  • EGMR, 25.03.2008 - 62605/00

    PETROL v. UKRAINE

The Court reiterates that, under Article 35 § 1 of the Convention, it may only deal with a matter after all domestic remedies have been exhausted, according to the generally recognised rules of international law, which only requires normal recourse by an applicant to remedies which are effective, sufficient and available (see, mutatis mutandis, MPP Golub v. Ukraine (dec.), no. 6778/05, ECHR 2005-..., and Karuna v. Ukraine (dec.), no. 43788/05, 3 April 2007).

Given the close link between the issues of exhaustion of domestic remedies and those of access to a court, the Court considers it appropriate to examine the complaints in relation to the aforementioned sets of proceedings from the point of view of the State's compliance with the applicant company's right of access to a court, guaranteed by Article 6 § 1 of the Convention (see MPP Golub v. Ukraine (dec.), no. 6778/05, ECHR 2005-...).
