Demgegenüber stelle es nach der Entscheidung des Europäischen Gerichtshofs für Menschenrechte vom 7. Oktober 2008, der sich auf seine Entscheidung vom 29. Juli 2004 in Sachen San Leonard Band Club v. Malta (Nr. 77562/01 ECHR 2004-IX) bezogen habe, einen Verstoß gegen Art. 6 Abs. 1 der Konvention dar, wenn Richter ihre eigenen angeblichen Fehler bewerten und über sie entscheiden und damit über sich selbst urteilen müssten.
