Nach der Rechtsprechung des Europäischen Gerichtshofs für Menschenrechte (EGMR) greift der Schutz durch Art. 8 EMRK bereits dann ein, wenn der leibliche Vater den Aufbau einer familiären Beziehung zu seinem Kind beabsichtigt und die Tatsache, dass sie nicht vollständig hergestellt werden konnte, ihm nicht zuzurechnen ist (vgl. EGMR, Pini a.o. v. Romania, Urteil vom 22. Juni 2004, Nr. 78028/01 u.a., §§ 143, 146; Ahrens v. Germany, Urteil vom 22. März 2012, Nr. 45071/09, § 58; Kautzor v. Germany, Urteil vom 22. März 2012, Nr. 23338/09, § 61).Unter Berücksichtigung der nach der Rechtsprechung des EGMR aus Art. 8 EMRK folgenden Gewährleistungen (vgl. EGMR, Pini a.o. v. Romania, Urteil vom 22. Juni 2004, Nr. 78028/01 u.a., §§ 143, 147; Ahrens v. Germany, Urteil vom 22. März 2012, Nr. 45071/09, § 58; Kautzor v. Germany, Urteil vom 22. März 2012, Nr. 23338/09, § 61) hat die verstärkende Wirkung auch dann Bedeutung, wenn schon der vom leiblichen Vater angestrebte Aufbau einer sozial-familiären Beziehung zu seinem Kind aus vom leiblichen Vater nicht verschuldeten Gründen erfolglos bleibt.

Roumanie (no 31679/96, CEDH 2000-I).Admettant que le droit à l'exécution est reconnu par la jurisprudence de la Cour comme un élément du droit d'accès à un tribunal, garanti par l'article 6 précité, et renvoyant aux opinions dissidentes exprimées par les juges Thomassen et Maruste sous les arrêts rendus par la Cour dans les affaires Ruianu (no 34647/97, 17 juin 2003) et Ignaccolo-Zenide (no 31679/96, CEDH 2000-I), le Gouvernement est d'avis qu'il peut exister des situations exceptionnelles autorisant les autorités de ne pas exécuter une décision, comme, par exemple, un changement dans la situation de fait (mutatis mutandis, Sylvester c. Admettant que le droit à l'exécution est reconnu par la jurisprudence de la Cour comme un élément du droit d'accès à un tribunal, garanti par l'article 6 précité, et renvoyant aux opinions dissidentes exprimées par les juges Thomassen et Maruste sous les arrêts rendus par la Cour dans les affaires Ruianu (no 34647/97, 17 juin 2003) et Ignaccolo-Zenide (no 31679/96, CEDH 2000-I), le Gouvernement est d'avis qu'il peut exister des situations exceptionnelles autorisant les autorités de ne pas exécuter une décision, comme, par exemple, un changement dans la situation de fait (mutatis mutandis, Sylvester c. Autriche, nos 36812/97 et 40104/98, 24 avril 2003).
